DEL PIZZO REZONING CONT'D CITY ATTORNEY REPORT MAYHOFFER SUIT ORDINANCE {fr49l ORDINANCE {f492 SALES TAX AMENDMENT RESOLUTION {f4, SERIES 1976 of the citizens and should be allowed to vote. Councilman DiCarlo requested permission from second to withdraw motion. Council- man Domenico withdrew his second therefore killing the motion. Councilman Caranci then moved that the request for rezoning be denied. Seconded by Councilman McDonald. Roll call on motion. Domenico no, Caranci yes, DiLorenzo yes, McDonald yes, DiCarlo no, DelPizzo no. Tie vote. Mayor Waschak declared Councilman DelPizzo's vote invalid; therefore the motion was carried to deny the rezoning request 3-2. Attorney Morris had nothing new to report. Councilman Caranci stated that there were several changes he would like to have in ordinance before publication. Attorney Morris stated that Council ordered the ordinance published therefore it must be published in that order and then on second reading the changes can be made. Attorney Morris stated that this Ordinance will give the state the authority to levy a tax in accordance with the schedule presented in the ordinance. Councilman Caranci moved that Ordinance {f492 be adopted. Seconded by Councilman McDonald. Councilman DiCarlo then moved to amend the motion to change the vendors license fee from $3.00 to ~2.50. Seconded by Councilman Caranci. Roll call on amend- ment: Domenico yes, Caranci yes, McDonald yes, DelPizzo yes, DiCarlo yes, DiLorenzo yes. Motion carried. Roll call on Ordinance as amended. Caranci yes, DiCarlo yes, DelPizzo yes, Domenico yes, DiLorenzo yes, McDonald yes. Motion carried. Attorney Morris read Resolution {f4 in regards to proceeding with the proposed Hillborough Annexation. Councilman DiCarlo moved that Resolution {f4, Series 1976, be adopted.
