RESOLUTION NO. 45 <br />SERIES 2023 <br />A RESOLUTION ORDERING A RECALL ELECTION FOR THE REGISTERED <br />ELECTORS OF WARD 2 TO BE HELD OCTOBER 3, 2023 AND AUTHORIZING THE <br />CITY CLERK TO APPOINT ELECTION JUDGES AND MAKE EXPENDITURES FOR <br />SAID ELECTION <br />WHEREAS, on June 7, 2023 a recall petition concerning the recall of Maxine Most <br />from the office of Louisville City Councilmember (Ward 2) was filed with the City Clerk; <br />and <br />WHEREAS, the City Clerk issued a Final Statement and Certificate of Petition <br />Sufficiency on June 23, 2023 finding that the recall petition was timely filed, was signed <br />by the requisite number of registered electors, and that no protests to the recall petition <br />were filed within the requisite time period; and <br />WHEREAS, the City Clerk has submitted the recall petition and a certificate of its <br />sufficiency to City Council; and <br />WHEREAS, pursuant to C.R.S. § 31-4-503(4), the City Council shall order and fix a <br />date for the recall election to be held not less than thirty days nor more than ninety days <br />from the date of submission of the petition to the governing body by the municipal clerk and <br />determine whether voting in the recall election is to take place at the polling place or by mail <br />ballot; and <br />WHEREAS, pursuant to Section 6-3 of the Louisville Home Rule Charter, a special <br />election, which is defined as a City election held at any time other than a regular election, <br />shall be called by a resolution adopted at least sixty days prior to the election; and <br />WHEREAS, by this resolution, the City Council intends to order a recall election <br />for the registered electors of Ward 2 on October 3, 2023, which such election shall be <br />conducted as a mail ballot election; and <br />WHEREAS, C.R.S. § 31-10-401 provides that the governing body of a municipality <br />may by resolution delegate to the Clerk the authority and responsibility to appoint judges <br />of election; and <br />WHEREAS, C.R.S. § 31-10-408 provides that election judges shall be <br />compensated at a rate determined by the governing body of the municipality; and <br />WHEREAS, the City Council wishes to authorize the City Clerk to appoint election <br />judges for the recall election and wishes to establish the rate of pay for election judges; <br />and <br />Resolution No. 45, Series 2023 <br />Page 1 of 3 <br />
