RESOLUTION NO. 44 <br />SERIES 2023 <br />A RESOLUTION DELEGATING AUTHORITY REGARDING VOTING IN WATER <br />ENTITY MEETINGS ON BEHALF OF THE CITY <br />WHEREAS, the City of Louisville ("City") has voting rights in various ditch, reservoir, <br />mutual ditch and reservoir companies; water companies, districts, conservancies, <br />authorities; and other similar entities (each a "Water Entity"); whose ditches, infrastructure, <br />and ditch right-of-way, easements, irrigation, laterals, canals, extensions, and other similar <br />infrastructure and rights are located within and/or pass through the City, or in which the City <br />otherwise has interest; and <br />WHEREAS, matters addressed in Water Entity meetings affecting the City's interests <br />in are typically administrative matters and, historically, votes on behalf of the City have been <br />cast by City representatives; and <br />WHEREAS, the City Council, by this resolution, desires to formally delegate to the <br />City Manager, or the City Manager's designee, the authority to vote on behalf of the City in <br />Water Entity meetings, and to formally ratify votes cast by City staff in past Water Entity <br />meetings. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. Except as otherwise required by state law or City ordinance, the City <br />Manager, or the City Manager's designee, is hereby authorized and directed to vote on <br />behalf of the City in meetings of ditch, reservoir, mutual ditch and reservoir companies; water <br />companies, districts, conservancies, authorities; and other similar entities in which the City <br />has voting rights (each a "Water Entity"). <br />Section 2.
