Planned Unit Development Amendment — Delo Plaza — Consideration of <br />Resolution 13, Series 2023, recommending conditional approval of an <br />amendment to the DELO Plaza PUD to allow an outdoor eating and serving area <br />at Rocky Mountain Tap and Beer Garden. <br />Applicant: Rocky Mountain Tap and Garden <br />Case Planner: Rob Zuccaro, Community Development Director <br />All notice was met as required and there is no commissioner conflict of interest. <br />Staff Presentation: <br />Zuccaro offered a resolution recommending conditional approval for the application. It is <br />Lot 1 within the Delo Plaza Commercial Center, which is bounded by Short St, South St <br />and Highway 42/Courtesy Rd. Zuccaro mentioned that the Commissioners will be <br />familiar with the proposed use based on a Temporary Use Permit (TUP) application last <br />year for the beer garden. <br />This is the first development of one of the out lots of this parcel. The applicant is <br />requesting permanent approval of a beer garden use. Zuccaro mentioned that the <br />application is unusual from a liquor license standpoint, but not from a site development <br />standpoint. <br />Rocky Mountain Tap and Garden is within a mixed use district and subject to those <br />standards and zoning guidelines. This PUD amendment is required because it is its own <br />development parcel and there was not an outdoor eating area previously approved. This <br />is not a special use review, rather it is a site development plan review. <br />The proposal is for a 10,000 sf enclosure with a fence and gate. It includes shade <br />features, gazebos, decorative lighting and planters, artificial turf and compact crushed <br />granite, which will require a waiver request for surface material since it is not stamped <br />concrete or pavers. The applicant has reclaimed the space from 11 parking spaces <br />planned as part of the PUD, which were never installed. The applicant is asking to defer <br />them, so if there ever was a proposed drive -through use that would be reevaluated. <br />Tap and Garden's liquor license currently only covers the indoor space, and alcoholic <br />beverages are provided to -go. Currently patrons have to cross the private drive aisle at <br />the crosswalk to use the beer garden space. The State's allowance for to -go liquor <br />licenses is set to expire in June 2025.
