SUBJECT: STAFF UPDATES <br />DATE: AUGUST 23, 2023 PAGE 2 OF 3 <br />Dark Sky Lighting <br />At its July 13 hearing, the Planning Commission continued the proposed Dark Sky <br />lighting ordinance and instructed staff to review Option 2 (substantial alterations and <br />additions) with the goal of bringing more aggressive compliance triggers for both <br />residential and nonresidential lighting. Staff revised Option 2 and made the following <br />changes to the proposed ordinance: <br />• Any residential addition (net increase in total SF) requires sitewide compliance <br />• Changes to 25% or more of exterior wall area or materials of an existing building <br />requires building compliance (both residential and nonresidential) <br />• Nonresidential building additions equal to 25% or more of existing building SF <br />requires sitewide compliance (with existing parking lot pole exemption) <br />Planning Commission reviewed the revised ordinance and adopted Resolution 14, <br />Series 2023 — Option 2, recommending approval to City Council of a Dark Sky lighting <br />ordinance with language requiring compliance for substantial alterations and additions. <br />The ordinance will come to City Council for a first reading, followed by a second reading <br />and public hearing this October. <br />Energy Code Update <br />There will be an open house on August 29 from 6 — 8 PM to provide additional <br />education on the adopted energy code, and also to allow businesses to provide <br />feedback on possible amendments and areas of concern. <br />Underpasses <br />The Louisville Revitalization Commission (LRC) entered into a Cooperation Agreement <br />with the City of Louisville to contribute funding for the construction of underpasses <br />within the Highway 42 Urban Renewal Area. The approved Cooperation Agreement <br />outlined the LRC's desire to provide the City with financial assistance for the <br />construction of underpass improvements at (1) South Boulder Road in the general <br />vicinity of Main Street (Underpass at Main/SBR), and (2) Highway 42 in the general <br />vicinity of South Street (Underpass at HW42/South). <br />In order to support the construction of the two underpasses, the LRC pledged the <br />following revenue: <br />• $7,750,000, if the City formally approves the construction of the Underpass at <br />Main/SBR, but not the Underpass at HW42/South; or <br />• $18,750,000 if the City formally approves the construction of the Underpass at <br />Main/SBR and the Underpass at HW42/South. <br />The Cooperation Agreement included the stipulation that the City and LRC, or either <br />party, shall have the right to terminate the agreement if bonds are not issued within 36 <br />months, in an amount sufficient to construct both underpasses. <br />Agenda Packet P. 12 <br />
