Section 4. Sections 8.2 through 8.7 of the City of Louisville Commercial Development Design Standards and Guidelines are hereby repealed in their entirety. Section 5. Section 8.1 of the City of Louisville Industrial Development Design Standards and Guidelines is hereby repealed and reenacted to read as follows: 8.1 Compliance with Outdoor Lighting Code Outdoor lighting shall comply with the Chapter 17.26 of the Louisville Municipal Code, as may be amended from time to time. Section 5. Sections 8.2 through 8.5 of the City of Louisville Industrial Development Design Standards and Guidelines are hereby repealed in their entirety. Section 6. Section 2.2.1 of the City of Louisville Industrial Development Design Standards and Guidelines are hereby amended by the addition of a new subsection L1, to read as follows: L1. Compliance with Outdoor Lighting Code Outdoor lighting shall comply with the Chapter 17.26 of the Louisville Municipal Code, as may be amended from time to time. Section 7. All provisions of the Design Handbook for Downtown Louisville concerning outdoor lighting are hereby repealed to the extent such provisions purport to regulate lighting outside of public rights -of -way. Section 8. Section 14 of the Mixed Use Development Design Standards and Guidelines, concerning Exterior Site Lighting, is hereby repealed and reenacted to read as follows: 14. Compliance with Outdoor Lighting Code Outdoor lighting shall comply with the Chapter 17.26 of the Louisville Municipal Code, as may be amended from time to time. Section 9. If any portion of this ordinance is held to be invalid for any reason such decisions shall not affect the validity of the remaining portions of this ordinance The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that any one part be declared invalid. Section 10. The repeal or modification of any provision of the Municipal Code of the City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred under such provision, and each provision shall be treated and held as still remaining in force for the purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, Ordinance No. 1858, Series 2023 Page 13 of 14
