Board of Adjustment <br />Meeting Minutes <br />April 19, 2023 <br />Page 2 of 11 <br />Berger reviews the procedures for the meeting; opens the public hearing; and <br />states there are six criteria, which must be met for the board to approve a <br />variance request. <br />Berger states that for the requested variance to be approved, five votes will be <br />needed to be affirmative. <br />Hassan verifies the application to be heard this evening is complete, and was <br />mailed to the surrounding property owners on April 4, 2023 published in the <br />Boulder Daily Camera on April 2, 2023 and the property was posted on April 4, <br />2023. <br />Cooper moves and Nakari seconds a motion that confirms that all requirements <br />have been satisfied and the application submitted by the applicant has been <br />properly filed. Motion passes unanimously by a voice vote. <br />Berger asks if anyone at the hearing has any objections to the hearing <br />procedures he described and asks if there were any other preliminary matters <br />that needed to be taken care of. None is heard. <br />Staff Presentation: <br />Hassan begins her presentation by saying that the property is located along an <br />interior lot on Augusta Drive in the Coal Creek Filing 4 neighborhood. The rear <br />yard faces out onto the Coal Creek Golf Course. The property is located in the <br />Coal Creek Ranch Filing 4 Planned Unit Development and Subdivision. It is also <br />part of the Coal Creek Ranch General Development Plan, which was last <br />amended in 1996. An administrative variance was granted to the previous <br />property owners in 2019 for a deck addition with a 2-foot encroachment into the <br />rear yard setback. The extent of the variance can be seen on the left. <br />The applicants propose an addition to the existing main -level deck areas that <br />would span the length of the rear of the house. The total footprint of the deck <br />including the stairs would be approximately 594 square -feet, with 169 square -feet <br />being a covered deck. The overall deck is 28ft long and 45 ft. wide. The deck is <br />about 9 ft. - 4 in. above grade and the covered patio is about 20 ft. - 2 in. above <br />grade at the highest roof ridge. <br />Approximately 255 square -feet of the deck will encroach into the 20-foot rear - <br />yard setback area. The encroachment area has a maximum depth of 9 ft. — 4 in., <br />and is 45 ft. wide. About half of the covered deck is in the setback encroachment. <br />The area in the setback allows the deck to wrap -around and connect the two <br />exterior patio doors on the house. <br />
