<br />AN ORDINANCE ADOPTING BY REFERENCE THE
<br />2023 NATIONAL ELECTRIC CODE
<br />WHEREAS. the City Council has adopted from time to time cer-
<br />tain building and construction standards including editions of the
<br />National Electric Code: and
<br />WHEREAS, it is deemed to be in the interest of the public
<br />health. safety and general welfare to adopt by reference thereto
<br />the updated edition of the National Electric Code: and
<br />WHEREAS, the City Council, after proper notice as required by
<br />law, has held a public hearing an this ordinance providing for the
<br />adoption of said code; and
<br />WHEREAS, the 2023 National Electric Code has been submitted
<br />to the City Council in writing and the City Council has determined
<br />that such code should be adopted as herein set forth,
<br />NOW, THEREFORE. BE IT ORDAINED BY THE CITY c0WWIL OF THE
<br />CITY OF LOUISVILLE, COLORADO :
<br />Section 1. Chapter Section 15,48.010 of the Louisville Municipal
<br />Code is hereby amended to read as follows (words added are un-
<br />derlined; words deleted are stricken through):

<br />Pursuant to C.R.S. Title 31, Article I6, as amended:
<br />The National fire Protection Association standard number T0. here-
<br />after known as the National Electrical Code. 2023 2020 Edition, pub-
<br />lished by the National fire Protection Association, 1 8atterymarch
<br />Park. Quincy, Massachusetts. 02169-7471. is hereby adopted by ref-
<br />erence as the Louisville Electrical Code as if fully set out in this or-
<br />dinance codified herein with the additions deletions, insertions and
<br />changes, if any, set forth herein. and such adoption is to have the
<br />same force and effect as if set forth herein in every particular. The
<br />purpose and subject matter of the National Electrical Code includes
<br />minimum regulations for the practical safeguarding of persons end
<br />minimum standardhazards

<br />other structures, including mobile homes, recreational vehicles and
<br />floating dwelling units, and other premises such as yards, carnivals,

<br />Electrical Code provides for the Issuance of permits. Inspections
<br />and the collection of fees therefor. The National Electrical Code Is
<br />adopted in full and without amendments, including the outline of
<br />contents, index and all appendices thereto.
<br />Section 2. Section 1548020 of the Louisville Municipal Code is here-
<br />by amended to read as follows (words added are underlined: words
<br />deleted are stricken through ):

<br />At least one copy of the 2023 2020 National Electric Code, certified
<br />to be true and accurate, shall be available for public inspection at
<br />the office of the Building Safety Division, during normal office
<br />hours. and the electronic version of the code can be obtained at the

<br />The city clerk shall M all times maintain a reasonable supply of cop-

<br />Sec 1548.030.-Permit tees.
<br />The permit lees for electrical work within the city stall be cal-
<br />culated in a0Cordenee with the fee adopted by 005010tlon of the City
<br />council from time to time.
<br />Sec. 15.48.040.- Interpretation.
<br />In case at a dispute or a question regarding the- interpretation• of
<br />the National Ekctrlcat Code where the matter is not specified by er•
<br />dinance of the city, the interpretation of the -state -electrical board
<br />and their policies shall prevail and be enforced as pat -of -the -No.

<br />Council hereby declares that it would have passed this ordinance
<br />and each part or parts hereof irrespective of the fact that any one
<br />part or parts be declared unconstitutional or invand.
<br />Section 4. The repeal or modification of any provision of any prior
<br />ordinance by this ordinance shall not release, extinguish, alter,
<br />modify. or change in whole or in part any penalty. forfeiture or lia-
<br />bility either civil or criminal, which shall have been incurred under
<br />such provision. and each provision shag be treated and held as still
<br />remaining in force for the purpose of sustaining any judgment, de-
<br />cree. Or order which can or may be rendered. entered, or made in
<br />such actions. suits, proceedings. or prosecutions.
<br />Section S. All other ordinances or portions thereof inconsistent or
<br />conflicting with this ordinance or any portion hereof are hereby re-
<br />pealed to the extent of such inconsistency or conflict.
