RESOLUTION NO. 76 <br />SERIES 2023 <br />A RESOLUTION APPROVING AN ADDENDUM TO WASTEWATER TREATMENT <br />PLANT SOLIDS HANDLING UPGRADE PROJECT PRE -CONSTRUCTION PHASE <br />SERVICES AGREEMENT WITH ASLAN CONSTRUCTION, INC. <br />WHEREAS, the City and Aslan Construction, Inc. ("CMAR") are parties to that certain <br />Construction Manager at Risk Pre -Constriction Phase Services Agreement, dated June <br />16th, 2023 ("Agreement"), for pre -construction services in connection with the City of <br />Louisville Wastewater Treatment Plant (WWTP) Solids Handling Upgrade Project (the <br />"Project"); and <br />WHEREAS, pursuant to subsection 4.3.1.3 of the Agreement, the CMAR is required <br />to provide services related to evaluations of and recommendations for the procurement of <br />long lead-time items (i.e., materials or equipment that have a longer production and/or <br />delivery time compared to other items in the manufacturing process) to meet the Project <br />schedule requirements; and <br />WHEREAS, in fulfillment of its obligations under subsection 4.3.1.3 of the <br />Agreement, the CMAR, along with the City's design consultant, JVA, Inc., has evaluated <br />and recommended the City's procurement of certain long lead-time items; and <br />WHEREAS, in fulfillment of its obligations under Section 2.8 of the Agreement, the <br />CMAR has selected certain manufacturers by way of a competitive bid process; and <br />WHEREAS, there has been prepared an addendum to authorize the CMAR's <br />procurement of the recommended long lead-time items for integration into the Project during <br />the construction phase, so long as the total cost of such procurements does not exceed <br />$880,986 (the "Addendum"). <br />WHEREAS, by this resolution the City Council desires to approve, and authorize the <br />Mayor to execute, the Addendum. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br />Section 1. The City Council hereby approves the First Addendum to Construction <br />Manager At Risk Pre -Construction Phase Services Agreement (the "Addendum"), by and <br />between the City of Louisville and Aslan Construction, Inc., in essentially the same form as <br />the copy of such Addendum that accompanies this resolution. <br />Section 2. The Mayor is hereby authorized to execute the Addendum on behalf <br />of the City, and the Mayor is hereby further authorized to negotiate and approve such <br />Resolution No. 76, Series 2023 <br />Page 1 of 2 <br />10 <br />
