City Council <br />Meeting Minutes <br />December 20, 2022 <br />Page 7 of 11 <br />Tess Weltzin, Lafayette, urged Council to approve the ordinance to address the climate <br />crisis for the next generation. This ordinance will help drive the path for energy <br />efficiency. She stated local action is what is needed. <br />Ilana Diddams, Louisville, urged a yes vote to support the goals of the City's <br />Sustainability Plan. She stated voting against the ordinance would not be addressing <br />the climate crisis and the sustainability goals. <br />Mayor Stolzmann ended the first round of public comments noting that she would not <br />take online comments given earlier problems with the system. She noted that she <br />already asked people to attend in person and as presiding officer she can make that <br />determination. She asked the City Attorney to review the Rules of Procedure for this <br />process. <br />City Attorney Kelly reviewed the Rules of Procedure noting the rules state that if there <br />are technical problems that preclude electronic participation, the in person meeting shall <br />continue if a quorum is present in the room. She added that the Rules state the chair <br />has reasonable discretion to apply the meeting procedures subject to the right of any <br />member of Council to appeal to the Council in which case the matter shall be resolved <br />by a vote of the members. <br />MOTION: Councilmember Leh moved to override the Mayor's decision to not take <br />electronic comments. He stated he wants to be sure to hear from those online if it is <br />possible. Seconded by Mayor Pro Tern Maloney. <br />VOTE: Motion passed by 4-3 vote with Mayor Pro Tern Maloney and Councilmembers <br />Fahey, Leh, and Dickinson voting yes. <br />Larry Donner, Louisville, stated he does not support this ordinance. He feels this <br />ordinance will ensure vacant buildings won't get repurposed and more businesses will <br />leave town. The codes are premature and we don't fully understand the impacts. <br />Susan Loo, Louisville, stated the previous cost estimates on residential net zero were <br />not accurate and it is likely these estimates for commercial are not accurate as well. <br />There hasn't been a full look at the details of what this ordinance will do. <br />Councilmember Brown stated this ordinance applies to new construction only. He noted <br />that staff did a great deal of public outreach on this and people were able to give input. <br />Councilmember Leh asked if the business community was specifically asked for input <br />on this ordinance as presented here. Director Zuccaro stated there was no specific <br />outreach to the business community about the code as drafted and presented here. <br />W <br />
