<br />ORDINANCE NO. 1553 <br />SERIES 2009 <br /> <br />AN ORDINANCE AMENDING SECTION 12-4(a) OF THE CITY <br />CHARTER AND PROVIDING FOR THE SUBMISSION OF THE <br />AMENDMENT TO A VOTE OF THE REGISTERED ELECTORS AT <br />THE NOVEMBER 3,2009 REGULAR ELECTION <br /> <br />WHEREAS, the City Council desires to submit to the registered electors of the City a <br />proposed amendment to Section 12-4(a) ofthe City Charter; <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 12-4(a) of the City of Louisville Home Rule Charter is hereby <br />amended to read as follows (words added are underlined; words deleted are stricken through): <br /> <br />Section 12-4. Lease-Purchases. <br /> <br />(a) Unless approved by the registered electors, the City shall not enter into <br />any lease purchase agreement. Any lease-purchase agreement entered <br />into by the City shall be approved by the City Council by non-emergency <br />ordinance. notwithstanding the elimination of any requirement in State <br />statues for such approval by non-emergency ordinance. <br /> <br />Section 2. The charter amendment provided for herein shall be submitted to a vote of <br />the registered electors at the November 3, 2009 regular municipal election to determine whether <br />the amendment shall take effect. <br /> <br />Section 3. The charter amendment provided for herein shall not take effect unless and <br />until a majority of the registered voters voting at the November 3, 2009 regular election vote <br />"yes" in response to the following ballot title: <br /> <br />SHALL SECTION 12-4(A) OF THE CITY OF LOUISVILLE HOME RULE <br />CHARTER BE AMENDED TO ELIMINATE THE REQUIREMENT FOR <br />VOTER APPROVAL OF ANY LEASE-PURCHASE AGREEMENT AND <br />TO PROVIDE THAT THE CITY MAY ENTER INTO A LEASE- <br />PURCHASE AGREEMENT IF SUCH AGREEMENT IS APPROVED BY <br />CITY COUNCIL BY NON-EMERGENCY ORDINANCE, WHICH <br />ORDINACE WOULD BE SUBJECT TO THE RIGHT OF VOTER <br />REFERENDUM? <br /> <br />Section 4. If any article, section, paragraph, sentence, clause, or phrase of this <br />ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect <br /> <br />1 <br />
