Councilman Domenico
stated that he could not vote yes on the approval
without having a clarification by Paul as to
whether this was legal or not. With no more
remarks, Mayor Waschak called for roll call vote.
Domenico no, Berry yes, Caranci yes, Dhieux yes,
DelPizzo yes. Motion carried.

Mayor Waschak opened the Public Hearing contin-
uation on HB 1041 Designating Hatters of State
Interest which began on June 25, 1975.
Mr. Wurl stated that Mr. Dennis Drumm was in
attendance to make the presentation.
Mr. Drumm read and reviewed the Recommendations
Pertaining to HB 1041 Identification, Desig-
nation and Administration.
During the review Mr. Drumm stated that on
July 25, 1975, there was a public hearing held
by - the Land Use Commission on their guidelines.
Mr. Drumm stated that the statue gave theLUC the
responsibility to prepare guidelines and they will
be law by virtue of the fact the statute assigned
the LUC that responsibility.
He also stated that LUC did adopt the document,
however there were many changes and there has
not been a final publication of the adoption from
the public hearing.
He stated that the guidelines will become official
possibly by the end of August after reviewed by
the Attorney General of the whole set of guidelines.
Mayor Waschak asked Mr. Drumm to explain what was
meant by the sentence stating that Louisville will
have greater flexibility in implementation of
HB 1041 related land use controls than was
originally anticipated.
Mr. Drumm stated that the LUC was holding to
the position that HB 1041 would be used for all
matters of state interest, however now they state
that there are others means of control such as
other statutes, P.U.D. etc.

Councilman DelPizzo asked Mr. Drumm about how
the County could come up with decisions about
subsidence when they have not personally made
any tests but are going by maps that they have.
Mr. Drumm stated that Mr. White attended a public
hearing. He stated that no guidelines have been
adopted and that the county is just designating,
so what they have done is place a moratorium
on all development until they get their guidelines.
