<br />He suggested that Council do nothing about designating guidelines about new communities <br />while the question of what a new community is still in court. He felt that as much action <br />be taken now, but leave new communities alone until it is out of court. He felt that <br />the City had no power to do anything with the Colorado Technological Center since it is <br />not in the City. He felt the City could work toward the guidelines which would be <br />for the designation of matters of state interest; such as procedures for designation <br />of matter of sate interest, but could not properly take any action specifically dealing <br />with property outside the City limits. <br /> <br />Councilman Domenico asked if some land alreadyin the Comprehensive plan could be de- <br />signated as matter of state interest if it was not within the posted limits. Mr. <br />Houlehan stated that under Boulder County he did not think so, however under the state <br />guidelines it possibily could be. <br /> <br />Mr. Houlehan reviewed the matter and procedures regarding the Mizel proposed annexation. <br /> <br />Mr. Houlehan stated that Louisville is probably the first to come up with the guidelines <br />designating matters of state interest. He felt that maximum input should be sought and <br />studied over very carefully for the final draft. <br /> <br />Mr. Conarroe asked who was paying to have the guidelines studied and drafted. Mr. Wurl <br />stated that the City was paying to have them drawn up and eventually all municipalities <br />will be doing the same. <br /> <br />Mr. Wurl informed everyone that with or without Mizel, the City would have to draft the <br />guidelines. <br /> <br />Mr. Houlehan stated one thing that should be considered is that Louisville belongs to <br />the Colorado Municipal League and there are several sources that possibily could help <br />with the drafting of guidelines. It did not seem feasible for each City to duplicate <br />the efforts of other cities, and it would be good to bring this problme to the <br />attention of the League, Colorado Legislative Councilor Land Use Commission and then have <br />several full time draftsmen hired by a central body where the cost could be shared by <br />municipalities in the state. They would come forth with model guidelines to be used. <br />Mr. Houlehan stated that Mr. Bermingham has drawn up some model guidelines and that Mr. <br />Drumms draft has the basic pattern of them, however, the draft does not read like a <br />law which would be used to govern affairs. <br /> <br />Councilman Berry stated that in the draft it states that such selection of and devel- <br />opment of new communities are the only guidelines that have been permantely adopted by <br />the L.U.C. He asked that in the court case if the City will know if the guidelines are <br />binding. <br />Mr. Houlehan stated that it could go either way. He stated that the question before the <br />Supreme Court is "Does Judge Neighbors have jurisdiction to bloc annexation by the City <br />of Louisville based on H.B. 1041." Mr. Houlehan stated that it would bring up more <br />questions and they will have to go further and have something to say in regards to the <br />Land Use Act, but it is not going to answer all possible questions that might come up. <br /> <br />Mr. Wurl asked when the dead line for the State was to have the guidelines for the <br />benefit of the communities. <br />Mr. Houlehan stated that they were to be done 180 days after the passage of the Land <br />Use Act. <br /> <br />-3- <br />
