<br />CITY ATTOfu~EY REPORT <br />MIZEL A1~NEXATION REPORT <br /> <br />RESOLUTION_1/l4 <br /> <br />ORDINANCE 1/472 <br />AMENDING ORDINANCE #446 <br /> <br />.. <br /> <br />SALES TAX <br /> <br />-5- <br /> <br />Attorney Morris stated that Mizel filed <br />in the Colorado SUDreme Court a writ <br />of prohibition whi~h if granted would <br />direct the district judge to show cause <br />why his temporary restraining order should <br />not be quashed. Attorney Morris stated <br />that Mizel will here on the matter during <br />the coming week. Attorney Morris stated <br />that there was a pre trail conference <br />set for May 22, 1975, at 9:00 a.m. to <br />try to define the issues and on May 27, 1975, <br />at 9:00 a.m. the trial will be held to <br />determine on the permanent or temporary <br />injunction. If the court adopts the <br />Land Use Commissions and the County's <br />position, it would prohibit the City from <br />annexing the property until the Land <br />Use Commission regulations have been <br />followed. He stated that one of the <br />issues in the court is whether or not <br />the Land Use Cow~ission has the authority <br />to state that the City of Louisville may <br />not receive the annexation and whether or <br />not the City has conjunctive rights over <br />the property with the county. Attorney <br />Morris passed out Resolution #14 <br />which would allow him to deal with the <br />litigation as he sees fit in the best <br />interest of the City <br /> <br />Attorney Morris read Resolution #14. <br />After discussion Councilman DelPizzo <br />moved that Resolution #14 be adopted. <br />Seconded by Councilman DiCarlo. Motion <br />carried. <br /> <br />.. 'i <br /> <br />Attorney Morris read Ordinance #472 <br />pertaining to Water Tap Charges. Mr. <br />Wurl stated that this Ordinance per- <br />tained mainly to multi-family dwellings. <br />After discussion, Councilman Caranci <br />moved that Ordinance #472 be ordered <br />published. Seconded by Councilman Berry. <br />Roll call. Caranci yes, Berry yes, Dhieux <br />yes, DelPizzo yes, DiCarlo no., Motion <br />carried. <br /> <br />Attorney Morris stated that he still has <br />no word from the State regarding the matter, <br />however, he will have an outline for <br />Council to review. <br />
