CITY ATTOfu~EY REPORT MIZEL A1~NEXATION REPORT RESOLUTION_1/l4 ORDINANCE 1/472 AMENDING ORDINANCE #446 .. SALES TAX -5- Attorney Morris stated that Mizel filed in the Colorado SUDreme Court a writ of prohibition whi~h if granted would direct the district judge to show cause why his temporary restraining order should not be quashed. Attorney Morris stated that Mizel will here on the matter during the coming week. Attorney Morris stated that there was a pre trail conference set for May 22, 1975, at 9:00 a.m. to try to define the issues and on May 27, 1975, at 9:00 a.m. the trial will be held to determine on the permanent or temporary injunction. If the court adopts the Land Use Commissions and the County's position, it would prohibit the City from annexing the property until the Land Use Commission regulations have been followed. He stated that one of the issues in the court is whether or not the Land Use Cow~ission has the authority to state that the City of Louisville may not receive the annexation and whether or not the City has conjunctive rights over the property with the county. Attorney Morris passed out Resolution #14 which would allow him to deal with the litigation as he sees fit in the best interest of the City Attorney Morris read Resolution #14. After discussion Councilman DelPizzo moved that Resolution #14 be adopted. Seconded by Councilman DiCarlo. Motion carried. .. 'i Attorney Morris read Ordinance #472 pertaining to Water Tap Charges. Mr. Wurl stated that this Ordinance per- tained mainly to multi-family dwellings. After discussion, Councilman Caranci moved that Ordinance #472 be ordered published. Seconded by Councilman Berry. Roll call. Caranci yes, Berry yes, Dhieux yes, DelPizzo yes, DiCarlo no., Motion carried. Attorney Morris stated that he still has no word from the State regarding the matter, however, he will have an outline for Council to review.
