Boulder County Clerk, CO ORD R 16.00 <br /> <br />2399136 <br /> <br />Pags: 1 of $ <br />02/21/2003 08:46A <br /> D 0.00 <br /> <br />ORDINANCE NO. 1408 <br />SERIES 2002 <br /> <br />AN ORDINANCE APPROVING A BOUNDARY LINE ADJUSTMENT <br />AGREEMENT AND, IN CONNECTION THEREWITH, THE EXECUTION <br />OF A QUIT CLAIM DEED AND VACATION OF A PORTION OF AN <br />ALLEY RIGHT-OF-WAY WITHIN THE JEFFERSON PLACE <br />SUBDIVISION IN THE CITY OF LOUISVILLE. <br /> <br /> WHEREAS, by the plat of the Jei~t~rson Place Subdivision, filed in October 1878, and the <br />plat of the Pleasant Hill Addition, filed in July 1894, a remnant parcel of land was created on the <br />northern side of Jefferson Place along South Street adjacent to the platted north property line of Lot <br />11, Block 11 of Jefferson Place Subdivision, such remnant being further described and depicted on <br />the Boundary Line Agreement Survey accompanying this Ordinance; and <br /> <br /> WHEREAS, the Owner of Lots 10 and 11, Block 11 of the Jefferson Place Subdivision, <br />Michelle Mangham, is requesting approval of a boundary line adjustment agreement to incorporate <br />portions of the unplatted remnant parcel, as further described on such Survey, into Lot 11; and <br /> <br /> WHEREAS, the Owner and the City wish to enter into such agreement and exchange quit <br />claim deeds to clarify ownership of the remnant parcel and the sidewalks and additional fights-of- <br />ways located within the remnant parcel and adjacent to Lots 10 and 11, Block 11; and <br /> <br /> WHEREAS, by the plat of the Jefferson Place Subdivision there was dedicated to the City <br />a fight-of-way for an alley lying adjacent to the platted west boundary of such Lots 10 and 11, <br />Block 11 of Jefferson Place Subdivision and such remnant parcel; and <br /> <br /> WHEREAS, proper application has been made to the City for vacation of any portions of <br />such previously platted alley lying within the area described on such Survey as the "Resulting <br />Parcel Description" for Lots 10 and 11, Block 11, Jefferson Place Subdivision; and <br /> <br /> WHEREAS, the City Council has determined that the alley right-of-way for which <br />vacation has been requested is not and has not been used or required as a roadway or thoroughfare <br />for the public; and <br /> <br /> WHEREAS, the City Council has determined that the alley fight-of-way for which <br />vacation is requested is not and will not be needed for any public purposes other than continued use <br />of existing public utilities, if any; and <br /> <br /> <br />
