Boulder County Clerk, CO ORD R 16.00 <br /> <br />2378880 <br /> <br />Page: 1 of 3 <br />0!/02/2003 08:21R <br /> D 0.00 <br /> <br />ORDINANCE NO. 1403 <br />SERIES 2002 <br /> <br />AN ORDINANCE APPROVING THE VACATION OF A PORTION OF A UTILITY <br />EASEMENT WITHIN LOT 3, CHRISTOPHER VILLAGE FOURTH FILING <br />SUBDIVISION <br /> <br /> WHEREAS, by the plat of Christopher Village Fourth Filing Subdivision, recorded in Plan <br />File P-33, F-l, #1-7, Boulder County Records ("Subdivision"), there was dedicated a certain ten- <br />foot utility easement lying within and along the east boundary of Lot 3 of said Subdivision; and <br /> <br /> WHEREAS, proper application has been made to the City to vacate a portion of such ten- <br />foot utility easement, which portion requested for vacation is legally described and depicted on <br />Exhibit A hereto; and <br /> <br /> WHEREAS, the City Council has determined that the easement area for which vacation is <br />requested is not and has not been used or required as a roadway or thoroughfare for the public; and <br /> <br /> WHEREAS, the City Council has determined that the easement area for which vacation is <br />requested is not and will not be needed for any public purpose; and <br /> <br /> WHEREAS, the City Council has determined that the easement area for which vacation is <br />requested is not being used or held for park purposes or for any other governmental purposes; and <br /> <br /> WHEREAS, the City Council desires to approve the application and vacate the City's <br />interests in the easement area described herein for which vacation is requested. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The City hereby vacates the City's interests in that certain portion of a ten- <br />foot utility easement lying within Lot 3, Christopher Village Fourth Filing Subdivision which is <br />legally described and depicted Exhibit A, attached hereto and incorporated herein by reference. <br />Such vacated easement area contains 783 square feet (0.018 acres), more or less. <br /> <br /> ~. Easements for existing public utilities, if any, shall not be altered or <br />amended by virtue of this ordinance. <br /> <br /> Section 3. The Mayor is hereby authorized to execute such additional documents as <br />may be necessary t° evidence the vacation effected by this ordinance. <br /> <br /> <br />
