Boulder County Clerk, CO ORD R 41 ,00 <br /> <br />2507531 <br /> <br />Pa~e: 1 of 8 <br />09/25/2005 11:01A <br /> D 0.00 <br /> <br />ORDINANCE NO. 1398 <br />SERIES 2002 <br /> <br />AN ORDINANCE APPROVING THE VACATION OF CERTAIN EASEMENTS AND <br />STREET RIGHT-OF-WAY WITHIN THE HEALTH PARK SUBDIVISION <br /> <br /> WHEREAS, by the plat of Health Park Subdivision Filing No. 5, recorded October 29, <br />1996, at Reception No. 1653634 in Plan File 38, F-3, #13, Boulder County Records (hereafter <br />"Health Park Subdivision Filing No. 5"), there was dedicated to the City of Louisville right-of-way <br />for a certain roadway designated thereon as Health Park Drive; and <br /> <br /> WHEREAS, by the plat of Health Park Subdivision Filing No. 5, there were also dedicated <br />certain access and utility easements within such Subdivision; and <br /> <br /> WHEREAS, the City has approved with conditions the subdivision plat of Health Park <br />Subdivision Filing No. 6, and such replat has resulted in the relocation of certain roadways, <br />accesses and utility easements; and <br /> <br /> WHEREAS, as part of the request for approval of Health Park Subdivision Filing No. 6, <br />proper application has been made to the City for vacation of a portion of the right-of-way for Health <br />Park Drive, and for vacation of certain accesses and utility easements, as dedicated by the plat of <br />Health Park Subdivision Filing No. 5, and as further described in this ordinance; and <br /> <br /> WHEREAS, the City Council has determined that the right-of-way to be vacated by this <br />ordinance is not required as a roadway or thoroughfare for the public; and <br /> <br /> WHEREAS, the City Council has determined that the City's interests in the easements to <br />be vacated by this ordinance are not used and will not be needed for the purposes for which they <br />were dedicated; and <br /> <br /> WHEREAS, the City Council has determined that the right-of-way and easement interests <br />to be vacated by this ordinance are not being used or held for park purposes or for any other <br />governmental purposes; and <br /> <br /> WHEREAS, the City Council has therefore determined that it is appropriate to vacate the <br />City's interests in the right-of-way and easements described herein. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. The City hereby vacates that certain portion of the right-of-way for Health <br />Park Drive, as dedicated by the plat of Health Park Subdivision Filing No. 5, that is depicted as <br /> <br /> <br />
