RECITALS WHEREAS, the County and the City have entered into an Intergovernmental Agreement fo:!:' Collection of County Use Taxes between Boulder County .:l.nd City of Louisville dated January 9, ::'996 (the County Use Tax IGA), "under which the City collects for the County thirty-five one-hundredths of one percent (.35%) tax on the p:!:"1.vilege of using or consuming in the Cou~ty any construction and building materials purchased at :!:"etail; and WHEREAS, pu:!:'suan:. to Resolution No. 98-123 and Section 29-2-101, .et. ~., C.R.S., the County enacted an additional countywide use tax of one-twen-cieth of one percent (.05%), effective January 1, 1999, for the privilege of using or consuming in the County any const:!:'uction and building materials purchased at retail; and WHEREAS, in order to irr~lement this additional use tax collection, ~he Cou~ty a~d the Ci:.y des~re to amend the existing County Use Tax IGA. KOW, THEREFORE.. in consideration of the mutual covenants and commi tmen~s, the partiE:s agree as follows: A. All of the terms and conditions of the County Use Tax lGA not amended herein shall remain ir. full force and effect' and shall apply to collection of this one-twentieth of one percent (.05%) tax. B. Section l.A.a is amended to read in its entirety: "Collect, administer and enforce the countywide use taxes in the total amount of forty Clne-hundred-chs of one percent (.40%) for the pr1. vilege of using Ole consuming, in accordance with and pursuant to County Resolutions Nos. 93~174, 94-162 and 98-123, Sections 29-2- 101, et sea., C.R.S., as a~ended, and the provisions of the City of Louisvil':"e Sales and Use Tax Ordinance, which are not inconsistent with :.he aforementioned Resolutions and state statutes."
