Board of Adjustment <br />Meeting Minutes <br />NOVEMBER 16, 2005 <br />Page 4 of 7 <br /> <br />Loeblich discussed the seriousness of the legal issues associated with the sewer line and the need <br />to have it addressed by the applicant. Other Board members agreed on the seriousness of the <br />problem. <br />Public Present in Opposition of Application: None heard. <br />Applicant Closing Comments: No additional comments. <br />Staff Closing Comments: No additional comments. <br />Public Hearing Closed / Board Discussion: <br />Stuart stated that all the criteria had been met and he supports the approval of the variance <br />requests. <br />Cordell stated that he supports the Staff recommendation. <br />Loeblich stated that he too supports the staff recommendation. He provided the following <br />additional comments of support: 1) the lot is less than ½ of the typical lot depth; 2) the requested <br />variances are more conforming than the current house; 3) the proposed structure will add value <br />to the area; and 4) supports the one condition of approval recommended by staff. <br />Weise supports the request and had no additional comments. <br />Malmquist supports the request and stated that the new structure will be an asset to Louisville. <br />Kelly agreed with the other Board members and had no additional comments. <br />Motion and Vote: <br />Loeblich moved and Cordell seconded a motion to approve Case No. 05-026-VA a two variance <br />request from Section 17.12.050 of the Louisville Municipal Code to allow the construction of a <br />new home that would reduce the minimum rear yard setback from 25 feet to approximately 16.5 <br />feet and reduce the minimum front yard setback from 20 feet to approximately 16 feet with the <br />one conditional of approval regarding the removal the shed that is currently on the lot. <br /> <br />Roll Call Vote: <br /> <br />Bill Cordell Yes <br /> <br />Gerry Kelly Yes <br /> <br />Horst Loeblich Yes <br /> <br />James Stuart Yes <br /> <br />John Weise Yes <br /> <br />Gunnar Malmquist Yes <br /> <br />Motion passed: 6 to 0 <br /> <br /> <br /> <br />Case No. 05-028-VA <br />; 2095 Eisenhower Dr., Lot 10, Block 1, Ponderosa; Cheryl <br />Branson; A variance request to reduce the rear yard setback from 25 to 11 feet (a <br />variance of 14 feet) and a portion of the side yard setback from 7 feet to 5 feet in a <br />Residential Low (RL) density zoning district for a covered patio. <br />Public Notice Verification: <br /> <br />
