Johnstone stated that it is approximately 8 feet. Loeblich inquired of the ability to add landscape, specifically trees. Johnstone stated that landscape would be permitted however, the property owner should be aware that any landscaping in a utility easement is subject to potential damage when work is needing to be done in the easement. Malmquist asked for a clarification of the pergola that is proposed. Johnstone described the pergola structure. Stewart moved and Weise seconded a motion to enter into record the three additional emails as presented by staff. Motion passed unanimously by voice vote. Applicant Presentation: Cheryl Branson, 2095 Eisenhower, presented a letter from the Home Owners Association Architecture Control Committee that gave their approval. Stuart moved and Loeblich seconded a motion to enter the letter into record as Exhibit “A”. Motion passed unanimously by voice vote. Several Board members inquired about the location of the property owner, Jeff Cousins, on Quail Circle that opposed the variance. Johnstone identified the location of Quail Circle. Branson continued by reporting that she had contacted and received support from all of her immediate neighbors. She also stated that no trellis is proposed because of the additional structural requirements that would be necessary to build it. Board Questions of Applicant: No additional questions. Public Present in Favor of Application: Becky Freeman, unknown address, stated she was a near neighbor and she does not oppose the requested variance. Sheila (unknown last name), 504 Eisenhower, also stated her support of the requested variance. Public Present in Opposition of Application: None heard. Applicant Closing Comments: No additional comments Staff Closing Comments: Johnstone stated that staff supports the variance and is recommending approval without conditions. Public Hearing Closed / Board Discussion: Loeblich stated that it is important that the pergola will not be fully enclosed. He also stated that he appreciates the support from the public. He also supports the findings as presented by Staff. He continued with a brief discussion of the opposition raised by Cousins and that the Board is not setting a precedent because of the unique lot circumstances as identified by Staff.
