Board of Adjustment <br />Meeting Minutes <br />NOVEMBER 16, 2005 <br />Page 6 of 7 <br /> <br />Board Questions of Staff: <br />Stuart requested clarification of the height of the structure to be built. <br />Johnstone stated that it is approximately 8 feet. <br />Loeblich inquired of the ability to add landscape, specifically trees. <br />Johnstone stated that landscape would be permitted however, the property owner should be <br />aware that any landscaping in a utility easement is subject to potential damage when work is <br />needing to be done in the easement. <br />Malmquist asked for a clarification of the pergola that is proposed. <br />Johnstone described the pergola structure. <br />Stewart moved and Weise seconded a motion to enter into record the three additional emails as <br />presented by staff. Motion passed unanimously by voice vote. <br />Applicant Presentation: <br />Cheryl Branson, 2095 Eisenhower, presented a letter from the Home Owners Association <br />Architecture Control Committee that gave their approval. <br />Stuart moved and Loeblich seconded a motion to enter the letter into record as Exhibit “A”. <br />Motion passed unanimously by voice vote. <br />Several Board members inquired about the location of the property owner, Jeff Cousins, on Quail <br />Circle that opposed the variance. <br />Johnstone identified the location of Quail Circle. <br />Branson continued by reporting that she had contacted and received support from all of her <br />immediate neighbors. She also stated that no trellis is proposed because of the additional <br />structural requirements that would be necessary to build it. <br />Board Questions of Applicant: No additional questions. <br />Public Present in Favor of Application: <br />Becky Freeman, unknown address, stated she was a near neighbor and she does not oppose the <br />requested variance. <br />Sheila (unknown last name), 504 Eisenhower, also stated her support of the requested variance. <br />Public Present in Opposition of Application: None heard. <br />Applicant Closing Comments: No additional comments <br />Staff Closing Comments: <br />Johnstone stated that staff supports the variance and is recommending approval without <br />conditions. <br />Public Hearing Closed / Board Discussion: <br />Loeblich stated that it is important that the pergola will not be fully enclosed. He also stated that <br />he appreciates the support from the public. He also supports the findings as presented by Staff. <br />He continued with a brief discussion of the opposition raised by Cousins and that the Board is <br />not setting a precedent because of the unique lot circumstances as identified by Staff. <br /> <br />
