Motion passed with a 5-1 vote, withh Levihn voting against. <br />ORDINANCE No. 1284, SERIES .1998 - AN ORDINANCE AMENDING TITLE 17 OF <br />THE LOUISVILLE MUNICIPAL CODE, ENTITLED `ZONING,' BY REZONING AS <br />PLANNED COMMUNI'CY ZONE DISTRICT COMMERCIAL (PCZD-C) <br />APPROXIMATELY 61 ACRES OF LAND DESIGNATED AS LOTS 1, 2, 4, AND 7, AND <br />ADJOINING RIGHTS-OF-WA.Y, HEALTH PARK SUBDIVISION, FILING No. 5 - 2nd <br />READING -PUBLIC H)H:ARING (Published Louisville Times 8/8/98) <br />Davidson. called for City Attorney introduction. <br />Sam Light, City Attorney, read aloud by title only, Ordinance No. 1284, Series 1998 - An Ordinance <br />Amending Title 17 of the Louisville Municipal Code, Entitled "Zoning," by Rezoning As Planned <br />Community Zone District Commercial (PCZD-C) Approximately 61 Acres of Land Designated as <br />Lots 1, 2, 4, and 7, and Adjoining Rights-of--Way, Health Park Subdivision, Filing No. 5. <br />Davidson called for staff presentation. <br />Paul Wood, Planning Director, stated the applicant is requesting to rezone approximately 61 acres <br />of Avista Health Park from Agricultural to Planned Community Zoned District Commercial. As a <br />requirement of a rezoning request., a (Jeneral Development Plan (GDP) has been submitted. The. <br />property was annexed and zoned Agricultural in 1986, with the subdivision following in 1987. The <br />character of development within the :Health Park, uses authorized, and the process under which <br />expansion and development aze reviewed track back to the annexation agreement and a Special <br />Review Use, both of which were approved in 1986. The Annexation Agreement states that such <br />development was to be done in general conformity with a 1987 PUD Concept Plan, showing the <br />development of the Health Caze Pazk,. The 1987 Preliminary PUD Concept Plan was amended in <br />both 1988 and 1989. <br />The first amendment was authorized in 1988 so as to reflect the accurate location of the hospital <br />footprint, address internal circulation changes, and show the addition of a parking structure. The <br />1989 amendment authorized the addition of the 16,250 sf Neurobehavioral Center for Centennial <br />Peaks Hospital, which has not been constructed. <br />In March of 1996, two residential lots on St. Andrews at the north end of the Health Park were <br />rezoned to PCZD-R. The existing PCZD-R zoning on the Health Park would not be affected by this <br />zoning request. <br />The GDP, if authorized, will replace the Preliminary PUD Concept Plan as the primary guide in <br />determining the type, character, acid density of future Health Park expansion. Wood continued his <br />presentation (see attached Council Communication). <br />Davidson opened the Public Hearing and called for the applicant's presentation. <br />4 <br />
