Lathrop agrees with Howard on the building's design. He would like to see a patio/pedestrian area
included at the front of the store, away from vehicular traffic.

Keany addressed Linda Lowe regarding her opposition to Sam's Club locating in Louisville. He
stated that the land in the area Sam's Club is proposing to develop is zoned as commercial; therefore,
under use-by-right, only commercial development can locate in this area. Keany questioned whether
the lighting proposed exceeds the wattage limits stated in the DDSG, and whether Sam's Club turns
their lights off after hours.

Diesendorf stated the lights would be off after hours.

Keany expressed concern for local liquor businesses if Sam's Club chooses to lease space to a liquor
retailer.

Diesendorf stated they have not found such arrangements to be profitable.

Sisk expressed disapproval of the proposal due to its deficient landscaping requirements, in addition
an agreement to provide monetary contributions that assist the applicant. He requested that Sam'S'
Club not allow late night delivery trucks to use Dahlia Street. He agreed with Lathrop on a pedestrian
area. Sisk asked that Sam's Club make a commitment to contribute to and become part of the
community, outside of generating sales tax revenue.

Diesendorf agreed to look into ways they could contribute to the community.

Davidson explained that, as a statutory City, Louisville's authority is specifically granted by the State
Legislature. This authority does not include the ability to choose which stores and businesses can or
cannot come into Louisville. Decisions must be based ort zoning and standards such as the
Commercial Design Guidelines.

Sisk stated he felt that the sales tax agreement between the City and Sam's Club was to allow Sam's
Club to exceed Louisville's design standards.

Mayer agreed with Sisko

Howard moved that Council forward the Final PUD Development Plan Sam's Club - Parcel 0,
Centennial Valley Filing No.4 to Planning Commission with Council comments, seconded by
Mayer. All in favor.

Lathrop requested Council consider Agenda Item I - RECONSIDERATION OF COLONY
SQUARE, ORDINANCE NO. 1279, SERIES 1998 at this time.

Davidson asked ifthere were any Council objections to considering Agenda Item I at this time.

6
