<br />City Council <br />Meeting Minutes <br />October 6,2009 <br />Page 11 of 16 <br /> <br />Mayor Sisk opened the public hearing and requested public comment. There <br />were no comments. <br />COUNCIL COMMENTS <br /> <br />Mayor Pro T em Marsella asked if there is a notification process for vendors who <br />rely on the databases. Finance Director Watson explained the vendors may be <br />worldwide. Notice is on the City's web site, and local vendors will be notified. <br /> <br />Councilor Muckle requested an explanation for the suspension of the LMC <br />Subsection D of Section 3.20.412. Finance Director explained in May of 2008 <br />the City passed ordinance No. 1534, which was part of the tax simplification <br />program prompted by the State of Colorado and the Colorado Municipal League <br />for address locator databases. However, one or more of the databases contain <br />erroneous information and due to the complexity of the Colorado laws, sales tax <br />dollars are submitted to the wrong jurisdiction. Through sales tax audits, it has <br />been determined until the process is rectified, the City is requesting Subsection D <br />of Section 3.20.412 be suspended. City Manager Fleming explained this will <br />allow the City more leverage in dealing with the vendors to resolve the sales tax <br />collections issues. <br /> <br />Mayor Pro T em Marsella asked why the section is being suspended instead of <br />repealed. Finance Director Watson explained that section can be suspended by <br />resolution, rather than repealing the ordinance. The Finance Department will <br />develop their own database to address difficulties experienced by both in-state <br />and out-of-state vendors. <br /> <br />MOTION: Mayor Pro Tem Marsella moved to approve Ordinance No. 1556, <br />Series 2009 on final reading, seconded by Councilor Clabots. Roll call vote was <br />taken. The motion carried by a vote of 7-0. <br /> <br />RESOLUTION No. 33, SERIES 2009 - A RESOLUTION SUSPENDING <br />ORDINANCE No. 1534, SIECTION 3.20.412 ELECTRONIC DATABASE; <br />RET)!~ILER HELD HARMLESS <br /> <br />MOTION: Councilor Muckle moved to approve Resolution No. 33, 2009, <br />seconded by Mayor Pro T em Marsella. All in favor. <br /> <br />ORDINANCE No. 1557, SERIES 2009 - AN ORDINANCE AMENDING <br />CERTAIN SECTIONS OF TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE <br />TO ADOPT REGULATIONS REGARDING MEDICAL MARIJUANA <br />DISPENSARIES - Public Hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Culley read Ordinance No. 1557, Series 2009. <br />
