<br />City Council <br />Meeting Minutes <br />October 6, 2009 <br />Page 13 of 16 <br /> <br />Town of Superior have determined medical marijuana dispensaries are in <br />violation of State law. <br /> <br />City Attorney Culley suggested a 120 day moratorium. If the legislators have not <br />provided regulation within that time period, Council can extend the moratorium. <br /> <br />Councilor Dalton asked why Council could not adopt a moratorium conditioned <br />on the actions of the state relative to medical marijuana. City Attorney Culley <br />explained moratoriums bring up property rights and the interests of individuals <br />issues, so long term moratoriums are not recommended. <br /> <br />Councilor Dalton suggested a suspension rather than a moratorium. City <br />Attorney Culley suggested waiting until the next meeting to discuss a moratorium <br />or suspension. <br /> <br />Councilor Muckle requested the City Attorney's office provide information at the <br />next Council meeting, relative to the legality of Broomfield County's and the Town <br />of Superior's determination that medical marijuana dispensaries are in violation <br />of State law. <br /> <br />Mayor Sisk requested public comment. <br /> <br />PUBLIC COMMENT <br /> <br />June Joerns, 818 W. Mahogany Circle, Louisville, CO voiced her opposition to <br />the ordinance permitting medical marijuana dispensaries in the City of Louisville. <br /> <br />Garrett Mundelein, 520 Main Street, Louisville, CO explained he has been <br />approached by companies who wish to build medical marijuana growing facilities. <br />He voiced his concern over the different levels of marijuana; one for medical <br />marijuana, and the other as a social drug. He asked Council to address the <br />specific use of medical marijuana. He voiced his confusion on medical marijuana <br />dispensaries and asked if it is !~rown on site, or whether it is brought in. <br /> <br />Rian McPhee, 1950 Garfield Avenue, Louisville, CO voiced his support for the <br />ordinance. He explained a medical marijuana business ordinance is being <br />considered by the cities of Longmont and Thornton. He cited various sections of <br />the ordinance relative to the business merits of medical marijuana dispensaries. <br /> <br />Michelle Ley, 405 Andrew Way, Superior, CO stated she is a potential business <br />owner for medical marijuana dispensary and has selected a space in Louisville <br />for a Health and Wellness Center. She spoke to the surrounding business <br />owners and reported they support her business plan. <br />
