SIMMONS <br />CITY ADMINISTRATOR <br />DATE: October 19, 1999 <br />SUBJECT: Resolution No. 52, Series 1999 A Resolution of Substantial Compliance Bowes Annexation <br />Petition. <br />ORIGINATING DEPARTMENT: PLANNING DEPARTMENT <br />The landowner /applicant Mr. Jack Bowes is petitioning the City to commence a voluntary annexation of <br />approximately 77.87 acres. Mr. Bowes has submitted the attached annexation petition to initiate <br />voluntary annexation for his property located at the southeast corner of So 88 Street and Dillon Road. <br />The Bowes Annexation Map reflects two ownership parcels within the boundaries of the annexation. <br />Parcel One, which comprises the majority of the land area at 76.89 acres, is located in the northwest quarter <br />of Section 20. Parcel Two is .98 acres and is located in the northeast quarter of Section 19. Both sections <br />are located in Township 1 South, Range 69 West. In 1996 the City of Louisville purchased from the <br />Bowes Family a 3.473 acre parcel out of Parcel Two for right -of -way purposes: The right -of -way was used <br />for the construction of the re- aligned South 88 Street. Parcel Two, at .98 acres, is what remains exclusive <br />of the acquired right -of -way. The Annexation Map also reflects a Parcel Three at 2.20 acres, which is that <br />portion of the Dillon Road right -of -way which is still under the ownership of the Mr. Bowes. Parcel Three <br />is not part of the annexation request as the City of Louisville has already annexed that portion of the Dillon <br />Road right -of -way. <br />The property is currently. occupied by the family homestead, as well as associated out buildings. The <br />property owner is requesting that the property be. zoned to Planned Community Zone District Residential <br />(PCZD -R) in conjunction with the annexation. The applicant has submitted a PCZD General Development <br />Plan (GDP) to reflect the proposed planning area, and'residential development. <br />In February of 1999, with the approval of the Intergovernmental Agreement (IGA) for the Southeast <br />Boulder County, South 96 Street, Dillon Road and US 287 Area Comprehensive Development Plan, the <br />subject parcel was designated as a City Preservation Area. The IGA specifies; "that if and when annexed to <br />the City of Louisville, future use shall be limited to agriculture and low density of no more than 1 unit per 4 <br />acres, and prior to any annexation .that the parcel be designated a Rural Preservation." <br />RECOMMENDATION: If City Council desires to approve the resolution of substantial compliance for the <br />Bowes Annexation, ACCEPT A MOTION TO APPROVE RESOLUTION NO. 52, SERIES 1999. <br />L <br />Resolution No. 52, Series 1999 <br />Resolution of Substantial Compliance <br />Bowes Annexation <br />6A <br />
