January 1997 shall be pro- rated. Rent shall be made payable to the <br />City at 749 Main Street, Louisville, CO 80027. <br />4. Lessee shall at all times during this lease, and at <br />Lessee's sole cost and expense, maintain in a good, safe, and <br />habitable condition the Leased Premises, including the single <br />family dwelling and any other improvements. The City shall have no <br />obligation to repair, replace, improve or maintain any portion of <br />the Leased Premises. Lessee shall use reasonable care to prevent <br />waste, damage or injury to the Leased Premises. Lessee shall <br />comply with all applicable ordinances, resolutions, rules, and <br />regulations in Lessee's use and occupancy of the Leased Premises. <br />At the termination of the lease by lapse of time or otherwise, <br />Lessee shall deliver up the Leased Premises in as good a condition <br />as when Lessee took possession, excepting ordinary wear and tear <br />and damage by acts of God. If Lessee fails to comply with its <br />obligations under this Paragraph, the City may at its option, <br />terminate this Lease Agreement as provided herein or take such <br />measures as it determines necessary to bring the Leased Premises <br />into compliance with the terms of this Paragraph, and the cost of <br />any such measures shall be paid by the Lessee. <br />5. The Leased Premises is presently exempt from any real <br />property taxation. In the event the Boulder County Assessor <br />determines that the Leased Premises is subject to the lien of <br />general property taxes due to Lessee's use or occupancy, the Lessee <br />shall be responsible for the payment of taxes. <br />6. Lessee shall be solely responsible for payment of all <br />utility services for the Leased Premises, and shall promptly pay <br />all utility charges as they become due. Lessee shall be solely <br />responsible for any shall promptly pay for all labor performed on <br />and material furnished to the Leased Premises at the instance of <br />Lessee. <br />7. The City shall have no responsibility, liability, or <br />obligation with respect to the safety or security of any personal <br />property placed or located on, at, or in the Leased Premises, it <br />being acknowledged and understood by Lessee that the safety and <br />security of any such property is the sole responsibility and risk <br />of Lessee. <br />8. The City shall at all times have the right to enter the <br />Leased Premises to inspect, improve, maintain, alter or utilize the <br />Premises in any manner authorized to the City and which does not <br />unreasonably interfere with Lessee's use and enjoyment of the <br />Premises, including the right to utilize or allow the utilization <br />of the Leased Premises for the installation and maintenance of City <br />or public utility facilities. In the exercise of its rights <br />pursuant to this Lease Agreement, Lessee shall avoid any damage or <br />interference with any City installations, structures, utilities, or <br />improvements on, under, or adjacent to the Leased Premises. <br />2 <br />
