Notices shall <br />be effective upon mailing. <br />14. Waiver by the City of any breach of any term of this <br />Lease Agreement shall not be deemed a waiver- of any subsequent <br />breach of the same or any other term or provision thereof. <br />15. At the termination of the Lease, the Lessee at its sole <br />option and expense may remove from the Leased Premises any items of <br />personal property owned by Lessee.. Lessee may also remove at its <br />sole option and expense any fixtures, structures, or improvements <br />owned by Lessee or on the Leased Premises at the time of execution <br />hereof, except the wire fencing on the boundaries of the Leased <br />Premises. Any items of personal property not removed by the date <br />of termination shall become the property of the City, and Lessee <br />shall execute and deliver to the City, at the time of termination, <br />a Bill of Sale for such items of personal property. <br />16. This Lease Agreement is subject to ratification by the <br />Louisville City Council, and is personal to the parties hereto. <br />The Lessee shall not sublease the Leased Premises, or transfer or <br />assign any rights under this Lease Agreement, for monetary or any <br />other consideration, without the prior written approval of the <br />City, which approval is solely at the discretion of the City. <br />17. In the event of any dispute or litigation arising under <br />the terms of this License to secure or enforce its rights, or in <br />the event of nonperformance of any obligation arising under this <br />License, the City, if it prevails in such dispute, shall be <br />entitled, in addition to other damages or costs, to receive from <br />Lessee court costs and reasonable attorneys' fees. <br />IN WITNESS WHEREOF, the parties have entered into this Lease <br />Agreement on the date first above written. <br />4 <br />
