ORDINANCE NO. 1242, SERIES 1997 AMENDING THE PLANNED UNIT DEVELOPMENT REGULATIONS CONTAINED IN CHAPTER 17.28 OF THE LOUISVILLE MUNICIPAL CODE TO INCORPORATE INTO SUCH REGULATIONS SPECIFIC REFERENCES AND REQUIREMENTS CONCERNING COMMERCIAL AND INDUSTRIAL DEVELOPMENT DESIGN GUIDELINES; TO SPECIFICALLY ADDRESS THE EF14ECT OF APPROVAL OF A PRELIMINARY PLANNED UNIT DEVELOPMENT PLAN, AND TO MAKE OTHER AMENDMENTS TO CHAPTERS 15.04, 17.16 AND 17.28 OF THE LOUISVILLE MUNICIPAL CODE IN CONNECTION THEREWITH 2ND READING PUBLIC HEARING (RE -PUBL. LSVL. TIMES 3/22/97) CONTINUED FROM 3/18/97 MEETING Griffiths read by title only Ordinance No. 1242, Series 1997, "An ordinance amending the Planned Unit Development regulations contained in Chapter 17.28 of the Louisville Municipal Code to incorporate into such regulations the Louisville Coiriinercial Development Design Standards and Guidelines; to incorporate into such regulations specific references and requirements concerning commercial and industrial development design standards and guidelines; to specifically address the effect of approval of &Preliminary Planned Unit Development Plan, and to make other amendments to Chapter 17.28 of the Louisville Municipal Code in connection therewith." Davidson reopened the public hearing that was continued from March 18, 1997. Paul Wood, Planning Director, explained that on January 28, 1997, a joint work session between the City Council, Planning Commission and affected property owners was held and a committee was appointed to evaluate the guidelines in light of concerns voiced by affected property owners. The committee recommended a series of format and content modifications which had been incorporated into the revised Commercial Development Design Standards and Guidelines (CDDSG). There were nine sections of the CDDSG in which full consensus was not reached. Section 4 of the ordinance adopts the CDDSG as an appendix to Chapter 17.28 of the Municipal Code which contain the City PUD regulations. The ordinance retains for Council the flexibility to waive or modify any requirements of the CDDSG within the PUD process. The ordinance had been amended to clarify 3
