Howard asked Koelbel about the exterior site lighting and the 24' pole height being unacceptable. Howard asked Koelbel about the parking lot orientation. Lathrop commented that once a standard had been established, it becomes the standard. It has to be a very very good reason to waiver from that. The burden is solely placed upon the applicant to demonstrate the reason to waiver from that. Koelbel stated that at Eagle Hardware they have 30' poles because to get a certain level of foot candle that is needed for certain requirements in the parking lot, there is a disproportionate amount of increase in the amount of standards you need, if you go 24' vs. 30'. It is an expense and an esthetic issue. Koelbel stated that there are certain planning issues and requirements of large users that demand more than that. They have to have a certain number of parking stalls within a certain radius of the front door. Requiring 25% to go around the side, they may never achieve that requirement. If their requirement is not met, there is a good chance you will lose them. Howard asked Martin how Council could reconcile her commercial needs with some of their safety concerns. Martin stated that at the last Planning Commission meeting the site was accepted with exception to the drive -thru with four issues. None of those said absolutely that a drive -thru could not be placed sp that it was between the building and McCaslin Boulevard. The issues had to do with pedestrian crossing, pedestrian gathering areas, the stacking for the drive -thru, and the viability of the drive -thru. She pointed out that this document says that there will be no drive -thru placed between a public street and an establishment, which eliminates this drive -thru totally. Mayer felt the document would do what the citizens want to be done, maintaining high standards for Louisville. He was told by one of the Broomfield City Council members that a number of businesses coming to Interlocken could not meet their standards, which are higher than Centennial Valleys. He said they just send them down to Louisville. He did not want Louisville viewed as a place that will accept lesser quality development than the surrounding areas. He was convinced that Jay Keany, Kevin Howard, Bill Boulet, and Bill Simmons represented the City fairly in this and the guidelines represent a modest attempt at keeping high quality development in Louisville without an unreasonable burden on the property owner. Sisk asked the City Attorney's opinion on Koelbel feeling they would come under the Gateway Design Guidelines. Susan Griffiths, City Attorney, stated that their opinion is that Centennial Valley is not exempt entirely from the proposed guidelines, rather the Gateway Guidelines include provisions which would cause other ordinances of the City to apply to Centennial Valley.
