ORDINANCE NO. 1387 <br />SERIES 2002 <br /> <br />AN EMERGENCY ORDINANCE AMENDING SECTION 13.08.120 OF THE <br />LOUISVILLE MUNICIPAL CODE REGARDING WASTE OF WATER <br /> <br /> WHEREAS, the City Council finds that drought conditions within the Boulder Creek <br />drainage and State of Colorado are currently impacting and threatening the City's available water <br />supply; and <br /> <br /> WHEREAS, it is estimated that, under current conditions, the City must reduce its <br />summertime water usage by 50% in order to have adequate water supplies; and <br /> <br /> WHEREAS, by Executive Order effective May 15, 2002, the Mayor of the City of <br />Louisville has placed certain mandatory watering restrictions upon users of the City of Louisville <br />water system because of such drought conditions, and in order to conserve water supplies; and <br /> <br /> WHEREAS, because of such drought conditions, the City Council finds it is necessary to <br />make certain amendments to Section 13.08.120 of the Louisville Municipal Code regarding waste <br />of water. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 13.08.120 of the Louisville Municipal Code is hereby amended to <br />read as follows (words to be added are underlined; words to be deleted are ~hickcn thro,,gh): <br /> <br />Sec. 13.08.120. Waste of Water Prohibited;_Ee, aalli~ <br /> A Wasting of water is prohibited and all consumers shall prevent <br />unnecessary waste of water and keep all water outlets closed when not in actual use. <br />Hydrants, urinals, water closets, bathtubs, and other openings must not be left <br />running for any purpose other than the use for which they were intended. <br /> Any consumer: user or other nerson violating any provision of this <br />section 13.08_120 or of any executive order entered by the mayor pursuant to section <br />13.08_060 shall he guilty of a municipal offense and shall he punished by a fine hut <br />not imprisonment. The amount of such fine shall he determined by the municipal <br />court_ 1 lpon a second and each subsequent conviction for such an offense: and in <br />addition to such fine~ the City may discontinue water service m the property served: <br />or the City. may install a flow restriction device upon the service line to the properly. <br />served to limit water service to that necessary for health and sanitary pn~oses only. <br />No such discontinuance of or restriction upon water service shall extend for more <br />than ten days for each conviction. At least ten days notice and an oppominity to be <br />heard shall he given prior to each discontinuance or restriction of water service <br /> <br /> <br />
