C. The fine paid by the licensee shall be equivalent to twenty percent <br />(20%) of the licensee's estimated gross revenues from sales of alcoholic <br />beverages during the entire period of the proposed suspension. However, in no <br />event shall the fine be less than two hundred dollars ($200.00) nor shall it be more <br />than five thousand dollars ($5,000). The Local Licensing Authority may use any <br />reasonable method to determine the licensee's estimated gross revenues from <br />sales of alcoholic beverages during the period of the proposed suspension. <br /> <br /> D. Payment of any fine authorized by the terms of this section shall be <br />made by the licensee in the form of cash, certified check, or cashier check made <br />payable to the City of Louisville, and shall be credited to the general fund. <br /> <br /> E. Upon receipt of the fine from the licensee in the form of payment <br />specified in paragraph D of this section, the Local Licensing Authority shall enter <br />an order permanently staying the entire period of the suspension or that period <br />which is not otherwise conditionally stayed. <br /> <br /> F. If the Local Licensing Authority does not make the findings <br />required in paragraph B of this section, or the licensee fails within the time <br />specified by the licensing authority to pay the fine imposed pursuant to this <br />section, or the licensee tenders payment of the fine in a form other than as <br />authorized in paragraph D of this section, the suspension shall go into effect on <br />the operative date finally set by the Authority. <br /> <br /> G. The Local Licensing Authority shall only grant such stays of the <br />suspension of the licensee's license as may be necessary for the Authority to <br />complete the investigations authorized in paragraph B of this section, make <br />findings, and, if it makes findings authorizing the imposition of a fine as <br />authorized in this section, permanently stay the entire period of the suspension or <br />that portion of the suspension not otherwise conditionally stayed. <br /> <br /> Section 2. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City <br />Council hereby declares that it would have passed this ordinance and each part hereof <br />irrespective of the fact that nay one part be declared invalid. <br /> <br /> Section 3. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br /> <br />
