City payment for the Property shall be made in cash, certified funds or City <br />warrant, subject to the Intergovernmental Agreement and to any necessary budgetary transfers or <br />supplementary budgets and appropriations in accordance with State law. <br /> <br /> Section 3. Nothing in this Ordinance is intended to nor should be construed to create <br />any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. The City <br />Council hereby further states its intent that the IGA for purchase of the Property shall include a <br />provision stating that any City obligation to make payments thereunder shall be from year to year <br />only, and payments thereunder shall be subject to annual appropriation in the sole and absolute <br />discretion of the City Council of the City, subject only to the requirement that the purchase of the <br />Property shall be given priority for any open space funds appropriated in the year in which the <br />closing on the Property will occur. <br /> <br /> Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 5.
