Boulder County Clerk, CO ORD R 16.00 2378878 Page: 1 of 3 Ol/02/2003 08:21R D ORDINANCE NO. 1379 SERIES 2002 AN ORDINANCE APPROVING AN ANNEXATION, KNOWN AS THE AVISTA ADVENTIST HOSPITAL ANNEXATION, TO THE CITY OF LOUISVILLE, COLORADO WHEREAS, a petition for annexation of certain unincorporated property, to be known as the Avista Adventist Annexation, and described in Exhibit A attached hereto, has been filed with the City Council of the City of Louisville; and WHEREAS, pursuant to Sections 31-12-108 to -110, C.R.S., as amended, the City Council on March 5, 2002, held a duly-noticed hearing to consider the proposed annexation; and WHEREAS, notice of such hearing was published February 2, 9, 16 and 23, 2002 in the Daily Camera newspaper; and WHEREAS, the City Council, by resolution, has determined that the petition is in substantial compliance with the applicable laws of the State of Colorado, that the area proposed to be annexed is eligible for annexation, and further has determined that an election is not required, and further found that no additional terms and conditions are to be imposed upon said annexation except any provided for in said petition or in the annexation agreement for the property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The annexation to the City of Louisville of the property described in Exhibit A, attached hereto and incorporated herein by this reference, and known as the Avista Adventist Hospital Annexation, is hereby approved and such property is made a part of and annexed to the City of Louisville. Section 2. The annexation of said territory is subject to the conditions provided for in the petition for annexation of said property filed with the City of Louisville and to the terms and conditions of the annexation agreement for the property, The annexation of said territory is subject to the conditions that the annexation agreement be fully executed and recorded prior to the recording and effectiveness of this annexation ordinance, and that the agreement be executed by the City only after all such territory has been conveyed to and is owned by PorterCare Adventist Health Systems. Section 3. The annexation of said territory is further subject to the condition that the First Amendment to the U.S. 36 Corridor Comprehensive Development Plan Intergovernmental Agreement, in substantially the form of that proposed Amendment approved by Resolution No. 6, Series 2002, shall be fully executed and recorded prior to the recording and effectiveness of this annexation ordinance.
