<br />that anyone part be declared invalid. <br /> <br />Section 8. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br />Section 9. The restrictions contained herein shall not be construed to prohibit <br />development for which vested rights therefor have been acquired through, unless otherwise <br />determined by City Council, an estoppel against the City precluding the prohibition of such <br />development established by a final court judgment. Pursuant to the foregoing, it is determined that <br />the restrictions herein shall not apply to certificates of occupancy for developments identified as <br />Compassionate Pain Management, LLC, 1116 W. Dillon Road, Suite 7 and A1termeds, LLC 1156 <br />W. Dillon Road, Suite 3, as such developments and uses existed on October 20, 2009; provided, <br />however, that any such deve10pme:nt shall be permitted only to the extent such development is in <br />conformance with the vested rights so acquired and within the vesting period. <br /> <br />Section 10. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portion hereof are hereby repealed to the extent 'of such inconsistency or conflict. <br /> <br /> <br /> <br />4 <br /> <br /> <br />FIRST <br />,2009. <br /> <br />
