ORDINANCE NO. 1347 <br />SERIES 2000 <br /> <br />AN ORDINANCE AUTHOR/ZING THE PAYMENT OF CZTY MONEYS FOR THE <br />AC(~UISI'TTON OF A PARCEL OF REAL ESTATE IN DOWNTOWN LOUISVILLE <br /> <br /> WHEREAS, the City of Louisville and Steinbaugh Ace Hardware Co. have entered <br />into a Purchase Contract for the City's acquisition, for potential use for parking facilities <br />and other governmental purposes, of a parcel of land of approximately 5,840 square feet, <br />located at 824 Front Street, Louisville, Colorado, in the NE 1/4 of the SE 1/4, Section 8, <br />TlS, R69W, 6th P.M., and more particularly described on Exhibit A, attached hereto and <br />incorporated herein by this reference (hereinafter "the Property"); and <br /> <br /> WHEREAS, the Purchase Contract provides that the City shall pay the owner of <br />the Property a total purchase price of One Hundred and Forty-Five Thousand Dollars <br />($145,000.00) for the Property; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the source of <br />funding for such purchase and otherwise comply with Colorado Revised Statutes <br />regarding the acquisition of the Property, including but not limited to C.R.S. sections 31- <br />15-711 and 31-25-202. <br /> <br /> NOW, THEREFORE, B~E. IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO. <br /> <br /> .Section 1. Unless other funds become available for use by the City as <br />determined by the City Council, moneys from the City Capital Projects Fund shall be used <br />to pay the purchase price of the Property, which Property is described on Exhibit A and in <br />Purchase Contract therefor. <br /> <br /> Section 2. City payment for the Property shall be made in cash, certified funds <br />or City warrant, subject to the Purchase Contract and to any necessary budgetary <br />transfers or supplementary budgets and appropriations in accordance with State law. <br /> <br /> .Section 3. Nothing in this Ordinance is intended to nor should be construed to <br />create any multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br /> <br /> Section 4. If any portion of this ordinance is held to be invalid for any reason, <br />such decision shall not affect the validity of the remaining portions of this ordinance. The <br />City Council hereby declares that it would have passed this ordinance and each part <br />hereof irrespective of the fact that any one part be declared invalid. <br /> <br />Section 5. All other ordinances or portions thereof inconsistent or conflicting <br /> <br /> <br />
