ORDINANCE NO. 1342 <br />SERIES 2000 <br /> <br />AN EMERGENCY ORDINANCE ORGANIZING THE MAIN STREET LOUISVILLE <br />BUSINESS IMPROVEMENT DISTRICT, APPROVING ITS OPERATING PLAN AND <br />BUDGET, AND APPROVING AN INITIAL BOARD OF DIRECTORS THEREFOR <br /> <br /> WItEREAS, the City Council of the City of Louisville has received a Petition for the <br />Organization of the Main Street Louisville Business Improvement District within the City of <br />Louisville (the "District"), a proposed Operating Plan and Budget, and list of proposed appointees <br />to the Board of Directors thereof; and <br /> <br /> WItEREAS, the City Council, following notice as required by Section 31-25- ! 201 et seq., <br />C.R.S. held and concluded a public hearing at 7:00 p.m. on Tuesday, the 15th day of August, 2000, <br />at City Hall, 749 Main Street, Louisville, Colorado, at which time proponents and opponents of the <br />District had the opportunity to be heard; and <br /> <br /> WHEREAS, the City Council has found from the tax rolls of Boulder County, in which the <br />proposed District is located, that the total valuation for assessment of the taxable real and personal <br />property in the service area is $ 5,351,010.00; and <br /> <br /> WItEREAS, based upon the Petition for Organization and other evidence presented to the <br />City Council in the aforementioned public hearing, the City Council has found and does hereby find <br />that the petition has been signed in conformity with Part 12 of Article 25 of Title 31, C.R.S, that the <br />signatures on the petition are genuine, and that the signatures of petitioners represent the persons <br />who own real or personal property in the service area of the proposed district having a valuation for <br />assessment of not less than fifty percent, or such greater amount as the governing body may provide <br />by ordinance, of the valuation for assessment of all real and personal property in the service area of <br />the proposed District (the actual percentage being 59.52%) and who own at least fifty percent, or <br />such greater amount as the governing body may provide by ordinance, of the acreage in the proposed <br />district (the actual percentage being 52.12%); and <br /> <br /> WHEREAS, the City Council finds it to be in the best interests of the District to exclude <br />certain property from the District as described herein; further, all non-commercial properties within <br />the boundaries of the District, as required by Section 31-25-1208, C.R.S., are hereby excluded; and <br /> <br />WHEREAS, the petition sets forth: <br /> <br /> (a) The name of the proposed District, which shall include a descriptive name and <br />the words "business improvement district", to wit: "Main Street Louisville Business Improvement <br />District"; <br /> <br />(b) <br /> <br />A general description of the boundaries and service area of the proposed <br /> <br />District; <br /> <br /> <br />
