ORDINANCE NO. 1341 <br /> SERIES 20OO <br /> <br />AN ORDINANCE ESTABLISHING A PARKING IMPROVEMENT FEE TO ASSIST IN <br />MEETING PARKING NEEDS IN DOWNTOWN LOUISVILLE, AND AMENDING <br />CHAPTER 17.20 OF THE LOUISVILLE MUNICIPAL CODE AND THE LOUISVILLE <br />COMMERCIAL DEVELOPMENT DESIGN STANDARDS TO PROVIDE THAT OFF- <br />STREET PARKING REQUIREMENTS FOR DOWNTOWN LOUISVILLE MAY BE <br />SATISFIED IN WHOLE OR PART BY PAYMENT OF A PARKING IMPROVEMENT <br />FEE, AND FURTHER DEFINING PARKING REQUIREMENTS FOR FREESTANDING <br />BUILDINGS WITHIN DOWNTOWN LOUISVILLE OCCUPIED SOLELY BY A <br />RESTAURANT USE. <br /> WHEREAS, C.R.S. §31-23-301 et seq. authorizes the City to adopt zoning regulations, <br /> which shall, among other things, be designed to lessen congestion in the streets and facilitate the <br /> adequate provision of public requirements; and <br /> WHEREAS, C.R.S. §31-15-711 authorizes the City to provide for the construction, <br /> operation, and maintenance of public parking facilities; and <br /> WHEREAS, by Ordinance No. 1287, Series 1998, the City established off-street parking <br /> requirements for "Downtown Louisville", as defined in such Ordinance; and <br /> WHEREAS, the City Council desires to revise the parking requirements for Downtown <br /> Louisville to provide that such requirements may be met by either providing the specific minimum <br /> amount of off-street parking or, in lieu thereof, by paying a parking improvement fee; and <br /> WHEREAS, the City Council finds that in situations where development in Downtown <br /> Louisville does not provide its own off-street parking, the parking improvement fee will provide <br /> resources necessary to offset the impact to the City of that development upon existing on- and off- <br /> street public parking which serves Downtown Louisville; and <br /> WHEREAS, the parking improvement fee will be used to defray the cost of providing <br /> additional public parking which will serve Downtown Louisville and which is made necessary by <br /> new development within Downtown Louisville, and for the other parking-related purposes set forth <br /> in this ordinance; and <br /> WHEREAS, the City Council f'mds that the parking improvement fee established herein is <br /> reasonably designed to defray in part the overall costs of the facilities for which the fee is imposed, <br /> and that the fee reasonably relates to the needs created or contributed to by new development within <br /> Downtown Louisville; and <br /> WHEREAS, the parking improvement fee established herein is dedicated to the purpose of <br /> <br /> <br />
