ORDINANCE NO. 1341 SERIES 20OO AN ORDINANCE ESTABLISHING A PARKING IMPROVEMENT FEE TO ASSIST IN MEETING PARKING NEEDS IN DOWNTOWN LOUISVILLE, AND AMENDING CHAPTER 17.20 OF THE LOUISVILLE MUNICIPAL CODE AND THE LOUISVILLE COMMERCIAL DEVELOPMENT DESIGN STANDARDS TO PROVIDE THAT OFF- STREET PARKING REQUIREMENTS FOR DOWNTOWN LOUISVILLE MAY BE SATISFIED IN WHOLE OR PART BY PAYMENT OF A PARKING IMPROVEMENT FEE, AND FURTHER DEFINING PARKING REQUIREMENTS FOR FREESTANDING BUILDINGS WITHIN DOWNTOWN LOUISVILLE OCCUPIED SOLELY BY A RESTAURANT USE. WHEREAS, C.R.S. §31-23-301 et seq. authorizes the City to adopt zoning regulations, which shall, among other things, be designed to lessen congestion in the streets and facilitate the adequate provision of public requirements; and WHEREAS, C.R.S. §31-15-711 authorizes the City to provide for the construction, operation, and maintenance of public parking facilities; and WHEREAS, by Ordinance No. 1287, Series 1998, the City established off-street parking requirements for "Downtown Louisville", as defined in such Ordinance; and WHEREAS, the City Council desires to revise the parking requirements for Downtown Louisville to provide that such requirements may be met by either providing the specific minimum amount of off-street parking or, in lieu thereof, by paying a parking improvement fee; and WHEREAS, the City Council finds that in situations where development in Downtown Louisville does not provide its own off-street parking, the parking improvement fee will provide resources necessary to offset the impact to the City of that development upon existing on- and off- street public parking which serves Downtown Louisville; and WHEREAS, the parking improvement fee will be used to defray the cost of providing additional public parking which will serve Downtown Louisville and which is made necessary by new development within Downtown Louisville, and for the other parking-related purposes set forth in this ordinance; and WHEREAS, the City Council f'mds that the parking improvement fee established herein is reasonably designed to defray in part the overall costs of the facilities for which the fee is imposed, and that the fee reasonably relates to the needs created or contributed to by new development within Downtown Louisville; and WHEREAS, the parking improvement fee established herein is dedicated to the purpose of
