ORDINANCE NO. 1340 <br />SERIES 2000 <br /> <br />AN EMERGENCY ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE <br />MUNICIPAL CODE TO EXCLUDE TWO OR MORE PERSONS WHO ARE REGISTERED <br />SEX OFFENDERS FROM LIVING TOGETHER WITHIN RESIDENTIAL AREAS. <br /> <br /> WHEREAS, the City of Louisville is a statutory municipality existing under and by virtue <br />of the laws of the State of Colorado; and <br /> <br /> WHEREAS, C.R.S. § 31-23-301 et seq. authorizes the City to establish zoning districts and <br />zone district regulations within the City for the purpose of, among other things, promoting the <br />general safety and welfare of the inhabitants of the City; and <br /> <br /> WHEREAS, under such authority, the City is empowered to regulate and restrict the <br />definition of "family" for purposes of zoning; and <br /> <br /> WHEREAS, pursuant to C.R.S. § 31-23-303(1) & (2), such zoning regulations shall be <br />made with reasonable consideration, among other things, as to the City's peace, health, and safety, <br />and to the preservation of current residential land uses; and <br /> <br /> WHEREAS, the City of Louisville has reserved its residentially zoned areas for residential <br />uses by allowing only families and certain types of family-oriented occupancies; and <br /> <br /> WHEREAS, General Assembly of the State of Colorado has recognized the potential <br />dangers of sex offenders by stating that some sex offenders cannot or will not respond to treatment; <br />and <br /> <br /> WHEREAS, the General Assembly has required that sex offenders register with the local <br />law enforcement agency within seven days of becoming a temporary or permanent resident within <br />the agency's jurisdiction; and <br /> <br /> WHEREAS, the high rate of recidivism among sex offenders substantially increases the <br />potential risk of threat to public health and safety if sex offenders are permitted to reside within <br />residential neighborhoods; and <br /> <br /> WHEREAS, a concentration of sex offenders in a residential neighborhood increases the <br />potential risk of threat to public health and safety if sex offenders are permitted to reside in <br />residential neighborhoods; and <br /> <br /> WHEREAS, the provisions of this ordinance achieve a reasonable balance between the need <br />to provide suitable housing and effective treatment programs to sex offenders and the need to <br />promote the health, safety and welfare of all residents of the City. <br /> <br />3. <br /> <br /> <br />
