ORDINANCE NO. 1340
SERIES 2000

AN EMERGENCY ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE
MUNICIPAL CODE TO EXCLUDE TWO OR MORE PERSONS WHO ARE REGISTERED
SEX OFFENDERS FROM LIVING TOGETHER WITHIN RESIDENTIAL AREAS.

WHEREAS, the City of Louisville is a statutory municipality existing under and by virtue
of the laws of the State of Colorado; and

WHEREAS, C.R.S. § 31-23-301 et seq. authorizes the City to establish zoning districts and
zone district regulations within the City for the purpose of, among other things, promoting the
general safety and welfare of the inhabitants of the City; and

WHEREAS, under such authority, the City is empowered to regulate and restrict the
definition of "family" for purposes of zoning; and

WHEREAS, pursuant to C.R.S. § 31-23-303(1) & (2), such zoning regulations shall be
made with reasonable consideration, among other things, as to the City's peace, health, and safety,
and to the preservation of current residential land uses; and

WHEREAS, the City of Louisville has reserved its residentially zoned areas for residential
uses by allowing only families and certain types of family-oriented occupancies; and

WHEREAS, General Assembly of the State of Colorado has recognized the potential
dangers of sex offenders by stating that some sex offenders cannot or will not respond to treatment;
and

WHEREAS, the General Assembly has required that sex offenders register with the local
law enforcement agency within seven days of becoming a temporary or permanent resident within
the agency's jurisdiction; and

WHEREAS, the high rate of recidivism among sex offenders substantially increases the
potential risk of threat to public health and safety if sex offenders are permitted to reside within
residential neighborhoods; and

WHEREAS, a concentration of sex offenders in a residential neighborhood increases the
potential risk of threat to public health and safety if sex offenders are permitted to reside in
residential neighborhoods; and

WHEREAS, the provisions of this ordinance achieve a reasonable balance between the need
to provide suitable housing and effective treatment programs to sex offenders and the need to
promote the health, safety and welfare of all residents of the City.

3.
