ORDINANCE NO. 1339 <br />SERIES 2000 <br /> <br />AN ORDINANCE DELEGATING TO THE CITY ADMINISTRATOR THE AUTHORITY <br />TO ESTABLISH CITY WATER TAP FEES ON A QUARTERLY BASIS AND <br />AMENDING CERTAIN SECTIONS OF CHAPTER 13.12 OF THE LOUISVILLE <br />MUNICIPAL CODE IN CONNECTION THEREWITH. <br /> <br /> WHEREAS, the City Council finds that the costs of water necessary to supply the City's <br />waterworks, as well as other costs to be paid through the City's water tap fee, have increased <br />dramatically in recent years; and <br /> <br /> WHEREAS, the City Council finds that the increases it has adopted to the City's water tap <br />fee have not kept pace with the increases in such costs; and <br /> <br /> WHEREAS, the City Council finds that adjustment of the City water tap lee by ordinance <br />is a cumbersome procedure that does not allow timely adjustments to the water tap fee to reflect <br />increases in such costs; and <br /> <br /> WHEREAS, the City Council finds that, in order to allow for timely adjustments of the <br />water tap fee to reflect increases in such costs, the tap fee should be set and adjusted by the City <br />Administrator on a quarterly basis, subject to certain guidelines that will enable the City <br />Administrator to carry out the intent of the City Council; and <br /> <br /> WHEREAS, the City Council has determined that delegating to the City Administrator the <br />authority and responsibility to set water tap fees in the most efficient means to set and maintain <br />accurate and up-to-date water tap fees; and <br /> <br /> WHEREAS, the City Council has determined that such a method of setting the City's water <br />tap fee is necessary to properly and adequately finance the services provided by the City's water <br />activity enterprise. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Subsections C and D of Section 13.12.020 of the Louisville Municipal Code <br />are hereby amended to read as follows (words added are underlined; words deleted are sthehe~ <br />thr~gh): <br /> <br /> C. The amount of the tap lee for residential units shall be determined by <br />the city and shall be based upon the size of the tap, as calculated pursuant to the <br />provisions of the International Un~fom~, Plumbing Code then in effect, and by <br /> <br /> <br />
