ORDINANCE NO. 1338 <br /> SERIES 2000 <br /> <br />AN ORDINANCE AMENDING CHAPTER 9.40 OF THE LOUISVILLE <br />MUNICIPAL CODE CONCERNING PERMITS FOR LIVE MUSICAL <br />PERFORMANCES IN RESIDENTIAL AREAS. <br /> <br /> WHEREAS, pursuant to Chapter 9.40 of the Louisville Municipal Code, the City <br />Council currently holds a public hearing on all applications made for a live musical <br />performance permit; and <br /> <br /> WHEREAS, the City Council desires to delegate to the City Clerk the authority <br />to grant such permits, when no protests have been received from owners of property <br />within 200 feet of the site proposed for the performance. <br /> <br /> NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF <br />THE CITY OF LOUISVILLE, COLORADO: <br /> <br /> Section 1. Section 9.40.020 of the Louisville Municipal Code is hereby <br />amended to read as follows (words to be added are underlined; words to be deleted are <br />~): <br /> <br />Sec. 9.40.020. Permit required. <br /> <br /> A. It is unlawful for any person to allow or permit a musical group <br />to perform upon property he owns or occupies in an area zoned as <br />residential rural, residential estate, residential low density, residential <br />medium density or residential high density as defined and designated by <br />title 17 of this Code unless the owner or occupant of the property has <br />previously obtained a permit for a live musical performance ~ <br />cet:nc~! as'set forth in this chapter. <br /> <br /> B. It is unlawful for any person to perform as a part of a musical <br />group upon any property in an area zoned as residential rural, residential <br />estate, residential low density, residential medium density, or residential <br />high density as defined and designated by title 17 of this code unless the <br />owner or occupant of the property has previously obtained a permit for a <br />live musical performance ~:~^"~ '~'~ ~ ........~ <br /> ............. .~ ........ as set forth in this chapter. <br /> <br /> C. The provisions and restrictions of this section shall not apply to <br />any private club or business establishment which is duly licensed by the <br />city as of October 1, 1981, and which is located in any residentially zoned <br />area as defined in title 17 of this code. <br /> <br /> <br />
