ORDINANCE NO. :].336 <br />SER2ES 2000 <br /> <br />AN ORDINANCE AUTHOR2Z]NG THE PAYMENT OF CITY MONEYS FOR THE ACQUZS~r~ON OF <br />VACANT REAL ESTATE AND WATER R~GHTS FOR OPEN SPACE PURPOSES <br /> <br /> WHEREAS, the City of Louisville, City of Lafayette and County of Boulder intend to enter into a <br />Purchase Agreement with Al Barakah, L.L.C., for the acquisition, for open space purposes, of approximately <br />35.68 acres together with certain water rights (the "Property"); and <br /> <br /> WHEREAS, the Property is located on the northeast corner of the intersection of Highway 42 and <br />South 104th Street adjacent to the Louisville Cemetery, and is more particularly described in Exhibit A; and <br /> <br /> WHEREAS, Louisville, Lafayette and Boulder County shall pay the owner of the Property a total <br />purchase price of four hundred and fifty thousand dollars ($450,000.00), for the Property, with the City to <br />pay one hundred and twelve thousand five hundred dollars ($112,500.00) of the total purchase price; and <br /> <br /> WHEREAS, the City Council by this ordinance desires to identify the sources of funding for such <br />purchase and otherwise comply with Section 31-25-202, Colorado Revised Statutes. <br /> <br /> NOW~ THEREFORE~ BE Zl' ORDAZNED BY THE CZTY COUNCIL OF THE CITY OF <br />LOU]SV~LLE~ COLORADO: <br /> <br /> Section 1. Unless other funds become available for use by the City as determined by the City <br />Council, moneys from the City Conservation Trust Fund shall be used to pay the City's share of the purchase <br />price of the Property, which Property is described on Exhibit A and in the Purchase Agreement therefor. <br /> <br /> Section 2. City payment for the Property shall be made in cash, certified funds or City warrant, <br />subject to the Purchase Agreement and to any necessary budgetary transfers or supplementary budgets and <br />appropriations in accordance with State law. <br /> <br /> Section 3. Nothing in this Ordinance is intended to nor should be construed to create any <br />multiple-fiscal year direct or indirect City debt or fiscal obligation whatsoever. <br /> <br /> Section 4. Tf any portion of this ordinance is held to be invalid for any reason, such decision <br />shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that <br />it would have passed this ordinance and each part hereof irrespective of the fact that any one part be <br />declared invalid. <br /> <br /> Section 5.
