Boulder Coun%y Clerk, CO ORO R 25.88 ORDINANCE NO. 1325 SERIES 2000 2038383 Pa~e: 1 o£ 5 O 8.88 AN ORDINANCE APPROVING THE VACATION OF DEDICATED TO THE CITY OF LOUISVILLE TECHNOLOGICAL CENTER, FIRST FILING RAILROAD WITHIN EASEMENTS COLORADO WHEREAS, by document recorded as Plan File No. 9, F-I, numbers 38, 39 and 40, Film No. 1084, Reception No. 361999, Boulder County Records, there was dedicated to the City of Louisville a 45-foot wide railroad and drainage easement lying within Blocks 1, 2, 3 and 8, and a 50-foot wide railroad and drainage easement lying within Block 5, of the Colorado Technological Center, First Filing, Louisville, Colorado; and WHEREAS, as a result of subsequent platting, a portion of such easements now also lies within Lot 6, Block 7, The Business Center at C.T.C.; and WHEREAS, proper application has been made to the City for vacation of the City's interest in only the railroad portion of such easements, as the same affect Blocks 1, 2, 3, 5 and 8 of the Colorado Technological Center, First Filing, and Lot 6, Block 7, The Business Center at C.T.C.; and WHEREAS, the Burlington Northern Santa Fe Railway has provided a letter to the City stating that it has no objections to the proposed vacation; and WHEREAS, the City Council has determined that the City's interest in the railroad portion of the easements is not used and will not be needed for the purpose for which it was dedicated; and WHEREAS, the City Council has determined that the City's interest in the railroad portion of the easements is not being used or held for park purposes or for any other governmental purposes; and WHEREAS, the City Council has therefore determined that it is appropriate to vacate the City's interest in only the railroad portion of the easements; and WHEREAS, the easements were also dedicated for drainage purposes; and WHEREAS, in vacating its interest in the railroad portion of the easements, the City does not intend to vacate any interest in the drainage uses permitted for the easements. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The City hereby approves the vacation of the City's interest in the railroad 3.
