<br />VACATION OF EASEMENT
<br />
<br />THIS VACATION OF EASEMENT is made this 18th day of January, 2000, by the City of
<br />Louisville, a municipal corporation existing under and by virtue of the laws of the State of Colorado
<br />("City"), whose address is 749 Main Street, Louisville, Colorado 80027.
<br />
<br />RECITALS
<br />
<br /> WHEREAS, by document recorded as Plan File No. 9, F-l, numbers 38, 39 and 40, Film
<br />No. 1084, Reception No. 361999, Boulder County Records, there was dedicated to the City of
<br />Louisville a 45-foot wide railroad and drainage easement lying within Blocks 1, 2, 3 and 8, and a
<br />50ofoot wide railroad and drainage easement lying within Block 5, of the Colorado Technological
<br />Center, First Filing, Louisville, Colorado; and
<br />
<br /> WHEREAS, as a result of subsequent platting, a portion of such easements now also lies
<br />within Lot 6, Block 7, The Business Center at C.T.C.; and
<br />
<br /> WHEREAS, proper application was made to the City for vacation of the City's interest in
<br />only the railroad portion of such easements, as the same affect Blocks 1, 2, 3, 5 and 8 of the
<br />Colorado Technological Center, First Filing, and Lot 6, Block 7, The Business Center at C.T.C.;
<br />and
<br />
<br />WHEREAS, the City Council by ordinance has approved the application for vacation; and
<br />
<br /> WHEREAS, the City Council has determined that the City's interest in the railroad portion
<br />of the easements is not used and will not be needed for the purpose for which it was dedicated; and
<br />
<br /> WHEREAS, the City Council has determined that the City's interest in the railroad portion
<br />of the easements is not being used or held for park purposes or for any other governmental
<br />
<br />purposes.

<br /> NOW, THEREFORE, the City of Louisville hereby vacates its interest in the railroad
<br />portion only of that certain 45-foot wide railroad and drainage easement, and that certain 50-foot
<br />wide railroad and drainage easement, dedicated to the City by the subdivision plat of, and lying
<br />within Blocks 1, 2, 3, 5 and 8 of, Colorado Technological Center, First Filing, Louisville, Colorado,
<br />which subdivision plat is recorded as Plan File No. 9, F-l, numbers 38, 39 and 40, Film No. 1084,
<br />Reception No. 361999, Boulder County Records, and within Lot 6, Block 7, The Business Center at
<br />C.T.C., which subdivision plat is recorded as Plan File No. P-44, F-3, numbers 12 and 13,
<br />Reception No. 1827896, Boulder County Records.

<br />The City does not vacate, and specifically reserves, the drainage uses permitted for such 45-
<br />
<br />
<br />
