Boulder' Countg Cle~'k, C;O ORD R 2038382 Page: 3 ot 4 VACATION OF EASEMENT THIS VACATION OF EASEMENT is made this 18th day of January, 2000, by the City of Louisville, a municipal corporation existing under and by virtue of the laws of the State of Colorado ("City"), whose address is 749 Main Street, Louisville, Colorado 80027. RECITALS WHEREAS, by document recorded as Plan File No. 9, F-I, numbers 38, 39 and 40, Film No. 1084, Reception No. 361999, Boulder County Records, there was dedicated to the City of Louisville railroad and drainage easements lying within Lots 6 and 10, Block 3, of the Colorado Technological Center, First Filing, Louisville, Colorado; and WHEREAS, proper application was made to the City for vacation of the City's interests in such railroad and drainage easements as they affect Lots 6 and 10, Block 3, Colorado Technological Center, First Filing; and WHEREAS, the City Council by ordinance has approved the application for vacation; and WHEREAS, the City Council has determined that the portions of the railroad and drainage easements to be vacated are not used and will not be needed for the purposes for which they were dedicated; and WHEREAS, the City Council has determined that the portions of the railroad and drainage easements to be vacated are not being used or held for park purposes or for any other governmental purposes. NOW, THEREFORE, the City of Louisville hereby vacates its interests in those certain railroad and drainage easements located within Lots 6 and 10, Block 3, Colorado Technological Center, First Filing, Louisville, Colorado, which are more particularly described on Exhibit A attached hereto and incorporated herein by reference.
