L <br />City of Louisville Planning Department <br />July 17, 2008 <br />Ms. Carmel Whittier <br />533 County Road <br />Louisville, Co 80027 <br />Re: Accessory Building at 533 County Road <br />Ms. Whittier, <br />I am writing this letter in regards to your recently constructed accessory structure located on the <br />west side of your property at 533 County Road. The structure in question is a two-story garage, <br />with living space on the second floor, that receives access from the adjacent alley right-of-way. <br />This structure was approved as an accessory structure and must continue to be used as such. An <br />accessory structure may not be used as an additional dwelling unit or rented out as additional <br />living space. <br />As a brief history, this structure was reviewed as Building Permit #C06-0181 and was approved <br />by the Planning Department on December 4, 2006. At the time of the review, it was stated that <br />this structure was an accessory structure that was to be designed as a detached garage with livable <br />space on the second floor. In the Louisville Municipal Code, accessory structure is defined as "a <br />structure or use incidental or subordinate to the main use of the property, including a home <br />occupation which is located on the same lot, or on a contiguous lot in the same ownership, with <br />the main use". Based on the plans we reviewed, Staff calculated setbacks, height, water taps and <br />electrical fixtures based on the fact that this structure was an accessory use — only to be used as a <br />garage and guest quarters. Because this structure is not wired for a kitchen facility and is on the <br />same water tap as the existing principal structure, this structure is not designed to be a principal <br />structure. <br />However, It has since come to Staff's attention that you are wishing to either rent this structure <br />out or you would like to use this as a principal structure (primary residence) while you rent the <br />structure to the east. As stated above, this structure may not be used as a principal structure either <br />for rentals or as a primary residence, based on the above reasons. <br />Please feel free to contact me if you have any questions or comments regarding the above <br />information.
