CITY OF LOUISVILLE <br />BOARD OF ADJUSTMENT <br />STAFF REPORT <br />November 18, 2009 <br />APPLICANT: Richard Lopez; Lopez Law Office; 4450 Arapahoe Ave. #100; Boulder, <br />CO, 80303 <br />OWNER: Carmel Whittier; 533 County Road, Louisville, CO, 80027 <br />STAFF PLANNER: Gavin McMillan, Planner II <br />LOCATION: 533 County Road; A portion of Block 2, Acme Terrace Addition <br />ZONING: Residential Medium Density (RM) and Old Town Overlay Zone District <br />REQUEST: Case #09-011-VA — Approval of two variances from Chapter 17 of the <br />Louisville Municipal Code (LMC). The variances are described as <br />follows: <br />1. Variance from Section 17.12.050.F to allow a 14 feet 6 inch front <br />yard setback where 20 foot is required. <br />2. Variance from Section 17.12.050.G to allow for an attached garage <br />that is not setback 20 feet greater than the setback between the front <br />property line and the front building line of the dwelling. <br />BACKGROUND: <br />The owner's representative, Richard Lopez, has requested two variances for the property located at 533 <br />County Road. The first request is a variance to allow a 14 feet 6 inch front yard setback where 20 feet is <br />required. The second request is to allow an attached garage with a setback that is not 20 feet greater <br />than the setback between the front property line and the front building line of the dwelling. The request <br />was originally scheduled to be heard by the Board of Adjustment on September16, 2009. At the <br />applicant's request, the September hearing was continued to the November Board of Adjustment <br />meeting. <br />The subject property is a portion of Block 2 of the Acme Terrace Addition and currently contains a two <br />story single family home and a two story (20 feet tall) detached garage. The property is zoned <br />Residential Medium (RM) and is located in the Old Town Overlay District. The parcel is 14,573 square <br />feet. The Boulder County Assessor's records indicate that the original home at 533 County Road was <br />constructed in 1953. A permit was issued in 2007 to construct a two story garage on the rear of the <br />property. That permit was subsequently amended by the applicant twice.
