<br />City Council <br />Meeting Minutes <br />October 20,2009 <br />Page 11 of 15 <br /> <br />City Attorney Light reported in executive session, Council discussed real property <br />dispositions with respect to strategies for the potential disposition of property <br />owned by the City. Staff and the City Attorney were given direction by Council on <br />a potential acquisition of real property as well as strategy with respect to that <br />acquisition. <br /> <br />City Attorney Light reported the Louisville Code of Ethics requires disclosure of <br />any potential conflict of interest. When the discussion began two Councilors left <br />the executive session and did not participate in that discussion. <br /> <br />Councilor Dalton recused himself from the executive session and disclosed the <br />property in question is in close proximity to his home and may present a conflict <br />of interest. Councilor Sackett also recused himself from the executive session <br />because of the close proximity of the property to his home, which may present a <br />conflict of interest. <br /> <br />City Attorney Light reported on the second executive session, on possible <br />pending litigation on the Medical Marijuana Dispensaries Moratorium. The City <br />Attorney provided legal advicE~ to the Council. <br /> <br />ORDINANCE No. 1561, SE.RIES 2009 - AN EMERGENCY ORDINANCE OF <br />THE CITY OF lOUISVlllE ESTABLISHING A TEMPORARY MORATORIUM <br />ON THE ACCEPTANCE:1 PROCESSING, OR ISSUANCE OF APPLICATIONS <br />OR REQUESTS FOR BUSINESS REGISTRATION, SALES TAX LICENSES, <br />BUilDING PERMITS, AND CERTIFICATES OF OCCUPANCY FOR MEDICAL <br />MARIJUANA DISPENSARIES WITHIN THE CITY OF lOUISVlllE - 2nd <br />Reading - Public Hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No.1561, Series 2009. <br /> <br />Mayor Sisk opened the public hearing and requested a Staff presentation. <br /> <br />City Attorney Light explained the ordinance establishes a temporary moratorium <br />(six months) on the acceptance, processing, or issuance of applications or <br />requests for business registration, sales tax licenses, building permits, and <br />certificates of occupancy for medical marijuana dispensaries within the City of <br />Louisville. He explained there are two medical marijuana dispensaries currently <br />operating in the Colony Square Shopping Center. Each has completed a <br />building permit process and certificate of occupancies have been requested, but <br />have not been issued pending the outcome of Ordinance No. 1561. Council was <br />presented the following options: <br /> <br />1. Amend the ordinance to expressly exempt the two existing businesses. <br />
