Gastineau replied that since the site has been approved for a drive-in restaurant, they would be open <br />to a tenant proposing another drive-in restaurant. If a tenant proposed a different use, they were <br />willing to come before Council with a request for modification. <br /> <br />Howard moved that Council approve Resolution No. 11, Series 1998, amended Final PUD <br />Development Plan, Lot 2, Century Retail Center with prior amendments one through twelve as listed <br />in addition to an amendment that Century Office Park Road is complete prior to issuing a certificate <br />of occupancy, and that the parking spaces will be addressed at Lot 1 when it is presented to Council <br />on the next PUD, seconded by Keany. <br /> <br />Keany offered a friendly amendment that the overlot grading is reseeded in the phasing of the project, <br />accepted by Howard. <br /> <br />Sisk offered a friendly amendment that the landscaping green space be increased to reflect the 16% <br />discussed, accepted by Howard and seconder Keany. <br /> <br />Howard offered a friendly amendment that the PUD correctly reflect the parking calculations that <br />staff recommends, accepted by seconder Keany. <br /> <br />Sisk offered a friendly amendment that item No. 2 correctly reflect that the dedication fee is paid prior <br />to or at the time of the Final Plat recording, with the Mayor's signature, accepted by Howard and <br />seconder Keany. <br /> <br />All in favor with Davidson being absent. <br /> <br />RESOLUTION NO. 12, SERIES 1998 - FINAL SUBDIVISION PLAT, FINAL PUD <br />DEVELOPMENT PLAN - THE PARK AT CTC <br /> <br />Paul Wood, Planning Director, stated O'Connor Development had submitted a Final Subdivision and <br />PUD Development Plan for a 62 acre parcel located directly east of the Colorado Tech. Center. There <br />are 14 lots, ranging from 3.5 to 5.0 acres in area, zoned for light industrial uses. Access for the Park <br />at CTC is provided for. Proposed street sections for the internal public roads reflecting right-of-way <br />widths have been revised to reflect a 60' right-of-way with a 38-foot street section. The Final <br />Subdivision Plat reflected the required right-of-way dedications for both South 104th Street and <br />Cherry Street. A note shall be added to the Final Plat to clarify the plat conveyance as a means to <br />insure that the right-of-way has been included in the legal description describing the dedication. <br />Conveyance shall be by Special Warranty Deed in a form acceptable to the City. Landscaping <br />requirements have been met. There is a drainage and irrigation ditch easement along Cherry Street <br />providing irrigation water to the Maple Grove Water System. Staff and the ditch owner have raised <br />issues regarding the conflict between the location of the ditch/utility easement and the location of the <br />tree plantings reflected on the final landscape plan. The ditch owners have not agreed to the planting <br />of the trees with the ditch easement. The front setback proposed at 30' will need to be increased to <br />avoid conflicts with the ditch owner fights.
