RESOLUTION NO. 4 <br />SERIES 2000 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE <br />FOR INK! COFFEE COMPANY, LOT 6B, <br /> CENTENNIAL VALLEY PARCEL H <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Special Review Use (SRU) for Ink! Coffee Company, a commercial retail business, <br />located on Lot 6B, Centennial Valley Parcel H, Second Filing; and <br /> <br /> WHEREAS, the Fifth Amendment to the Amended and Restated Development <br />Agreement recorded on July 6, 1995 requires that standard restaurant and retail uses on Parcel <br />H are to be reviewed as a use by Special Review (SRU); and <br /> <br /> WHEREAS, Ink! Coffee Company is requesting a SRU to sell coffee, coffee beans, <br />food services as well as related merchandise utilizing approximately 1,200 SF in a mixed use <br />building on Lot 6B, Centennial Valley, Parcel H, Second Filing; and <br /> <br /> WHEREAS, the Planning Commission has reviewed the user specific information <br />submitted for the SRU against the required Special Review Use Criteria found in Section <br />17.40.100 of the Louisville Municipal Code and found that the proposed SRU use is in <br />compliance with that required criteria regarding both internal and external site compatibility; <br />and <br /> WHEREAS, after a duly noticed public hearing concerning said Special Review Use, the <br />Planning Commission recommended approval to the City Council, with conditions; and <br /> <br /> WHEREAS, the City Council finds that said Special Review Use should be approved <br />subject to the following conditions: <br /> <br />1. A note shall be added to the SRU plan that the window signage, both illuminated and non- <br /> illuminated, shall be prohibited. Temporary banners and temporary signage are not <br /> allowed on the building or on the lot at any time. <br /> <br />2. The special review use is granted to the applicant only. <br /> <br />3. All sign letter faces shall be garnet red in color. <br /> <br />4. Umbrellas utilized in the outside patio area, shall be solid in color and will not be utilized <br /> for additional advertising or signage. <br /> <br />The SRU approval shall be subject to revocation in the event operation of the use, as <br />described in the application, changes in such a manner that the operation becomes a fast- <br /> 1 <br /> <br /> <br />
