RESOLUTION NO. 27 <br /> SERIES 2000 <br /> <br />A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL <br /> VACANT REAL ESTATE AND WATER RIGHTS <br /> <br /> WHEREAS, the City of Louisville, City of Lafayette and County of Boulder desire to <br />purchase for open space purposes title to approximately 35.68 acres located on the northeast comer <br />of the intersection of Highway 42 and South 104th Street adjacent to the Louisville Cemetery, <br />together with certain water rights (the "Property"); and <br /> <br /> WHEREAS, the owner of the Property, A1 Barakah, L.L.C., has stated its desire to sell the <br />Property to Louisville, Lafayette and Boulder County upon the terms and conditions of a mutually- <br />agreeable purchase contract. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br /> 1. The proposed Esmail PurchaSe Agreement ("Purchase Contract") among the City of <br />Louisville, City of Lafayette, County of Boulder and A1 Barakah, L.L.C. regarding the Property is <br />hereby approved in essentially the same form as the copy of such Purchase Contract accompanying <br />this Resolution. <br /> <br /> 2. The Mayor is authorized to execute the Purchase Contract, except that the Mayor is <br />hereby granted the authority to negotiate and approve such revisions to said Purchase Contract as <br />the Mayor determines are necessary or desirable for the protection of the City, so long as the <br />essential terms and conditions of the Purchase Contract are not altered. <br /> <br /> 3.
